For the purposes of this Chapter: |
就本章而言: |
intellectual property rights refers to copyright and related rights, rights in trade marks, geographical
indications, industrial designs, patents, layout designs of integrated circuits, and rights in plant varieties as defined in the TRIPS Agreement. |
知识产权是指《TRIPS协定》定义的版权及相关权利,以及对商标、地理标识、工业设计、专利、集成电路布图设计及植物品种的权利。 |
Article 160 Intellectual Property Principles |
第一百六十条 知识产权原则 |
1. The Parties recognise the importance
of intellectual property rights in promoting economic and social development,
particularly in the new digital economy, technological innovation and trade. |
一、双方认识到知识产权在促进经济与社会发展,特别是在新数字经济、技术创新和贸易方面的重要性。 |
2. The Parties recognise the need to
achieve a balance between the rights of right holders and the legitimate
interests of users and the community with regard to protected subject matter. |
二、双方认识到,需要在权利人权利与被保护标的相关用户及群体的合法权益之间实现平衡。 |
Article 161 General Provisions |
第一百六十一条 总则 |
1. Each Party shall establish and maintain transparent intellectual property rights regimes and systems that: |
一、各方应当建立和维持透明的知识产权体制与体系,以便: |
(a) provide certainty over the protection and enforcement of intellectual property rights; |
(一)为知识产权保护和执法带来确定性; |
(b) tminimise compliance costs for business; and |
(二)使商业合规成本最小化; |
(c) facilitate international trade through the dissemination of ideas, technology and creative works. |
(三)通过传播思想、技术和创造性的工艺便利国际贸易。 |
2. Each Party reaffirms its commitment to the TRIPS Agreement and any other multilateral agreement relating to intellectual property to which both are party. |
二、各方重申对《TRIPS协定》及双方参加的与知识产权相关的其他多边协定的承诺。 |
3. For the purposes of this Chapter, the TRIPS Agreement is incorporated into and made part of this Agreement, mutatis mutandis. |
三、为本章之目的,《TRIPS协定》经必要修改后并入本协定,构成本协定的一部分。 |
Article 162 Contact Points |
第一百六十二条 联系点 |
Each Party shall designate a contact point or points to facilitate communications between the Parties on any matter
covered by this Chapter, and provide details of such contact points to the other Party. The Parties shall notify each other promptly of any amendments to the details of their contact points. |
各方应当指定一个或多个联系点,以便就本章所涉任何问题进行沟通,并应当将该联系点的详细信息提供给另一方。双方应当将联系点详细信息的修改情况及时通知对方。 |
Article 163 Notification and Exchange of Information |
第一百六十三条 通知和信息交流 |
1. Each Party shall: |
一、各方应当: |
(a) notify the other Party of any new laws that enter into effect in relation to intellectual property; |
(一)通知另一方任何与知识产权有关的新生效的法律; |
(b) exchange information relating to developments in intellectual property policy in their respective
administrations including on appropriate initiatives to promote awareness of intellectual property rights and systems; |
(二)就其在各自管理中制定的知识产权政策进行信息交流,包括有关提高知识产权权利及体系意识的适当动议; |
(c) inform the other Party of changes to, and developments in, the
implementation of intellectual property systems, aimed at promoting effective and efficient registration or grant of intellectual property rights; and |
(三)通知另一方有关知识产权体系执行中的变化和进展情况,以期促进知识产权的有效和高效的注册或授予; |
(d) exchange information regarding enhancement of intellectual property rights enforcement and related initiatives in multilateral and regional fora. |
(四)就加强知识产权执法及在多边和区域场合的相关倡议进行信息交流。 |
2. Any information or notification provided under this Article shall be conveyed through the contact points referred to in Article 162. |
二、本条规定的任何信息或通知应当通过第一百六十二条所指的联系点进行沟通。 |
Article 164 Cooperation and Capacity Building |
第一百六十四条 合作及能力建设 |
1. The Parties agree to cooperate with a view to increasing capacity in the development of intellectual property policy and eliminating trade in goods
infringing intellectual property rights, subject to their respective laws, rules, regulations, directives and policies. |
一、双方同意根据其各自的法律、法规、规章、指令及政策开展合作,以期提高在制定知识产权政策、消除侵犯知识产权的货物贸易行为方面的能力。 |
2. Each Party shall: |

(a) encourage and facilitate the development of contacts and cooperation between their respective government agencies,
educational institutions and other organizations with an interest in the field of intellectual property rights; |
(一)鼓励和便利各自政府部门、教育机构及其他在知识产权领域有利益的组织之间联系及合作的发展; |
(b) work to build upon and strengthen the cooperative ties between the
China National Intellectual Property Administration (“CNIPA”) and other relevant
institutions of China and the Intellectual Property Office of New Zealand (“IPONZ”); |
(二)致力于建立和加强中国国家知识产权局(“CNIPA”)及其他相关机构与新西兰知识产权局(“IPONZ”)之间的合作; |
(c) on mutually acceptable terms and subject to available funds, cooperate on: |
(三)在共同接受的条件下,根据可利用的资金,在以下领域开展合作: |
(i) appropriate initiatives to promote awareness of intellectual property rights and systems; |

(ii) educational and information dissemination projects on the use of intellectual property as a research and innovation tool; and |

(iii) training and specialization courses for public servants on intellectual property rights. |

Article 165 Genetic Resources, Traditional Knowledge and Folklore |
第一百六十五条 遗传资源、传统知识及民间传说 |
Subject to each Party’s international obligations, the Parties may establish appropriate measures to protect genetic resources, traditional knowledge and folklore. |
各方可根据其国际义务,采取适当的措施保护遗传资源、传统知识和民间传说。 |
Article 166 Consultation |
第一百六十六条 磋商 |
1. A Party may at any time request consultations with the other Party, with a view to seeking a timely and mutually
satisfactory resolution of any intellectual property issue within the scope of this Chapter. |
一、一方可随时要求与另一方举行磋商,以期就本章范围内的任何知识产权问题寻求及时、双方满意的解决方案。 |
2. Such consultation shall be conducted through the Parties’ designated contact points, and shall commence within 60
days of the receipt of the request for consultation, unless the Parties mutually determine otherwise. Each Party shall ensure its contact point is able to coordinate and facilitate a response on the issue under consideration. |
二、若缔约双方同意或依一缔约方请求,指定的联络点可以交换与另一缔约方有关的涉及本章项下任何问题的信息。通过联络点进行的沟通应当符合第十二章(透明度)第一百三十条(通报和信息提供)的规定。 |
3. Only in the case that such consultation fails to resolve any such issue, can a Party take actions pursuant to Chapter 16 (Dispute Settlement). |
三、只有在上述磋商未能解决问题的情况下,一方才可根据第十六章(争端解决)采取行动。 |
4. Notwithstanding paragraph 3, after the commencement of such consultation, if a Party considers that the
consultation fails to resolve the issue, it may take actions pursuant to Chapter 16 (Dispute Settlement) after notifying the other Party of such a decision. |
四、尽管有第三款规定,在磋商开始后,如果一方认为磋商不能解决问题,则其可在通知另一方后,根据第十六章(争端解决)采取行动。 |
5. Notwithstanding paragraph 1, a Party may deny the request for consultations by the other Party under this Article or
the continuance of those consultations with the other Party on any issue, with respect to which, the other Party has taken actions pursuant to Chapter 16
(Dispute Settlement) or the WTO Understanding on Rules and Procedures Governing the Settlement of Disputes. |
五、尽管有第一款规定,当另一方已根据第十六章(争端解决)或WTO《关于争端解决规则与程序的谅解》就有关问题采取行动后,一方可拒绝另一方根据本条就该问题进行磋商的要求,或拒绝继续与另一方就该问题进行磋商。 |
