The Contracting States, 缔约各国,
Moved by the desire to ensure in all countries copyright protection of literary, scientific and artistic works,
  出于保证在所有国家给文学、科学和艺术作品以版权保护的愿望;
Convinced that a system of copyright protection appropriate to all nations of the world and expressed in a universal convention, additional to, and without impairing international systems already in force, will, ensure respect for the rights of the individual and encourage the development of literature, the sciences and the arts,
  确信适用于世界各国并以世界公约确定下来的、补充而无损于现行各种国际制度的版权保护制度,将保证对个人权利的尊重,并鼓励文学、科学和艺术的发展;
Persuaded that such a universal copyright system will facilitate a wider dissemination of works of the human mind and increase international under-standing,

Have resolved to revise the Universal Copyright Convention as signed at Geneva on 6 September 1952 (hereinafter called “the 1952 Convention”), and consequently,

Have agreed as follows:
  为此特协议如下:

Article I

第一条

Each Contracting State undertakes to provide for the adequate and effective protection of the rights of authors and other copyright proprietors in literary, scientific and artistic works, including writings, musical, dramatic and cinematographic works, and paintings, engravings and sculpture.   缔约各国承允对文学、科学、艺术作品(包括文字、音乐、戏剧和电影作品,以及绘画、雕刻和雕塑)的作者及其他版权所有者的权利,提供充分有效的保护。

Article II

第二条

1. Published works of nationals of any Contracting State and works first published in that State shall enjoy in each other Contracting State the same protection as that other State accords to works of its nationals first published in its own territory, as well as the protection specially granted by this Convention.   一、任何缔约国国民出版的作品及在该国首先出版的作品,在其他各缔约国中,均享有其他缔约国给予其本国国民在本国首先出版之作品的同等保护,以及本公约特许的保护。
2. Unpublished works of nationals of each Contracting State shall enjoy in each other Contracting State the same protection as that other State accords to unpublished works of its own nationals, as well as the protection specially granted by this Convention.   二、任何缔约国国民未出版的作品,在其他各缔约国中,享有该其他缔约国给予其国民未出版之作品的同等保护,以及本公约特许的保护。
3. For the purpose of this Convention any Contracting State may, by domestic legislation, assimilate to its own nationals any person domiciled in that State.   三、为实施本公约,任何缔约国可依本国法律将定居该国的任何人视为本国国民。

Article III

第三条

1. Any Contracting 'State which, under its domestic law, requires as a condition of copyright, compliance with formalities such as deposit, registration, notice, notarial certificates, payment of fees or manufacture or publication in that Contracting State, shall regard these requirements as satisfied with respect to all works protected in accordance with this Convention and first published outside its territory and the author of which is not one of its nationals, if from the time of the first publication all the copies of the work published with the authority of the author or other copyright proprietor bear the symbol © accompanied by the name of the copyright proprietor and the year of first publication placed in such manner and location as to give reasonable notice of claim of copyright.   一、任何缔约国依其国内法要求履行手续,如缴送样本、注册登记、刊登启事、办理公证文件、偿付费用或在该国国内制作出版等,作为版权保护的条件者,对于根据本公约加以保护并在该国领土以外首次出版而其作者又非本国国民的一切作品,应视为符合上述要求,只要经作者或版权所有者授权出版的作品的所有各册,自首次出版之日起,标有©的符号,并注明版权所有者之姓名、首次出版年份等,其标注的方式和位置应使人注意到版权的要求。
2. The provisions of paragraph 1 shall not preclude any Contracting State from requiring formalities or other conditions for the acquisition and enjoyment of copyright in respect of works first published in its territory or works of its nationals wherever published.   二、本条第一款的规定,不得妨碍任何缔约国在本国初版的作品或其国民于任何地方出版的作品为取得和享有版权而提出的履行手续或其他条件的要求。
3. The provisions of paragraph 1 shall not preclude any Contracting State from providing that a person seeking judicial relief must, in bringing the action, comply with procedural requirements, such as that the complainant must appear through domestic counsel or that the complainant must deposit with the court or an administrative office, or both, a copy of the work involved in the litigation; provided that failure to comply with such requirements shall not affect the validity of the copyright, nor shall any such requirement be imposed upon a national of another Contracting State if such requirement is not imposed on nationals of the State in which protection is claimed.   三、本条第一款的规定,不得妨碍任何缔约国作出如下的规定:凡要求司法救助者,必须在起诉时履行程序性要求,诸如起诉人须通过本国辩护人出庭,或由起诉人将争讼的作品送交法院或行政当局,或兼送两处;但未能履行上述程序性要求,不应影响版权的效力,而且如对要求给予版权保护的所在地国家的国民不作这种要求,也不应将这种要求强加于另一缔约国的国民。
4. In each Contracting State there shall be legal means of protecting without formalities the unpublished works of nationals of other Contracting States.   四、缔约各国应有法律措施保护其他各缔约国国民尚未出版的作品,而无须履行手续。
5. If a Contracting State grants protection for more than one term of copyright and the first term is for a period longer than one of the minimum periods prescribed in Article IV, such State shall not be required to comply with the provisions of paragraph 1 of this Article in respect of the second or any subsequent term of copyright.   五、如果某缔约国准许有一个以上的版权保护期限,而第一个期限比第四条中规定的最短期限之一更长,则对于第二个或其后的版权期限,不应要求该国执行本条第一款的规定。

Article IV

第四条

1. The duration of protection of a work shall be governed, in accordance with the provisions of Article II and this Article, by the law of the Contracting State in which protection is claimed.   一、根据第二条和本条规定,某作品的版权保护期限,应由该作品要求给予版权保护所在地的缔约国的法律来规定。
2.   二、
(a) The term of protection for works protected under this Convention shall not be less than the life of the author and twenty-five years after his death. However, any Contracting State which, on the effective date of this Convention in that State, has limited this term for certain classes of works to a period computed from the first publication of the work, shall be entitled to maintain these exceptions and to extend them to other classes of works. For all these classes the term of protection shall not be less than twenty-five years from the date of first publication.
  (一)受本公约保护的作品,其保护期限不得少于作者有生之年及其死后的二十五年。但是,如果任何缔约国在本公约对该国生效之日,已将某些种类作品的保护期限规定为自该作品首次出版以后的某一段时间,则该缔约国有权保持其规定,并可将这些规定扩大应用于其他种类的作品。对所有这些种类的作品,其版权保护期限自首次出版之日起,不得少于二十五年。
(b) Any Contracting State which, upon the effective date of this Convention in that State, does not compute the term of protection upon the basis of the life of the author, shall be entitled to compute the term of protection from the date of the first publication of the work or from its registration prior to publication, as the case may be, provided the term of protection shall not be less than twenty-five years from the date of first publication or from its registration prior to publication, as the case may be.
  (二)任何缔约国如在本公约对该国生效之日尚未根据作者有生之年确定保护期限,则有权根据情况,从作品首次出版之日或从出版前的登记之日起计算版权保护期,只要根据情况从作品首次出版之日或出版前的登记之日算起,版权保护期限不少于二十五年。
(c) If the legislation of a Contracting State grants two or more successive terms of protection, the duration of the first term shall not be less than one of the minimum periods specified in sub-paragraphs (a) and (b).
  (三)如果某缔约国的法律准许有两个或两个以上的连续保护期限,则第一个保护期限不得短于本款(一)与(二)两项所规定的最短期限之一。
3. The provisions of paragraph 2 shall not apply to photographic works or to works of applied art; provided, however, that the term of protection in those Contracting States which protect photographic works, or works of applied art in so far as they are protected as artistic works, shall not be less than ten years for each of said classes of works.   三、本条第二款的规定不适用于摄影作品或实用美术作品;但这些缔约国对摄影作品或实用美术作品作为艺术品给予保护时,对上述每一类作品规定期限不得少于十年。
4.   四、
(a) No Contracting State shall be obliged to grant protection to a work for a period longer than that fixed for the class of works to which the work in question belongs, in the case of unpublished works by the law of the Contracting State of which the author is a national, and in the case of published works by the law of the Contracting State in which the work has been first published.
  (一)任何缔约国对某一作品给予的保护期限,均不长于有关缔约国(如果是未出版的作品,则指作家所属的缔约国;如果是已出版的作品,则指首先出版作品的缔约国)的法律对该作品所属的同类作品规定的保护期限。
(b) For the purposes of the application of sub-paragraph (a), if the law of any Contracting State grants two or more successive terms of protection, the period of protection of that State shall be considered to be the aggregate of those terms. However, if a specified work is not protected by such State during the second or any subsequent term for any reason, the other Contracting States shall not be obliged to protect it during the second or any subsequent term.
  (二)为实施本款(一)项,如果某缔约国的法律准予有两个或两个以上的连续保护期限,该国的保护期限应视为是这些期限的总和。但是,如果上述国家对某一特定作品在第二或任何后续的期限内,因某种原因不给予版权保护,则其他各缔约国无义务在第二或任何后续的期限内给予保护。
5. For the purposes of the application of paragraph 4, the work of a national of a Contracting State, first published in a non-Contracting State, shall be treated as though first published in the Contracting State of which the author is a national.   五、为实施本条第四款,某缔约国国民在非缔约国首次出版的作品应按照在该作者所属的缔约国首先出版来处理。
6. For the purposes of the application of paragraph 4, in case of simultaneous publication in two or more Contracting States, the work shall be treated as though first published in the State which affords the shortest term; any work published in two or more Contracting States within thirty days of its first publication shall be considered as having been published simultaneously in said Contracting States.   六、为实施本条第四款,如果某作品在两个或两个以上缔约国内同时出版,该作品应视为在保护期限最短的缔约国内首先出版。任何作品如在首次出版三十日内在两个或两个以上缔约国内出版,则应视为在上述缔约国内同时出版。

Article IVbis

第四条之二

1. The rights referred to in Article I shall include the basic rights ensuring the author's economic interests, including the exclusive- right to authorize repro-duction by any means, public performance and broadcasting. The provisions of this Article shall extend to works protected under this Convention either in their original form or in any form recognizably derived from the original.   一、本公约第一条所述的权利,应包括保证作者经济利益的各种基本权利,其中有准许以任何方式复制、公开表演及广播等专有权利。本条的规定可扩大适用于受本公约保护的各类作品,无论它们是原著形式还是从原著演绎而来的任何形式。
2. However, any Contracting State may, by its domestic legislation, make exceptions that do not conflict with the spirit and provisions of this Convention, to the rights mentioned in paragraph 1 of this Article. Any State whose legislation so provides, shall nevertheless accord a reasonable degree of effective protection to each of the rights to which exception has been made.   二、但是,任何缔约国根据其国内法可以对本条第一款所述的权利做出符合本公约精神和内容的例外规定。凡法律允许做出例外规定的任何缔约国,必须对已做出例外规定的各项权利给予合理而有效的保护。

Article V

第五条

1. The rights referred to in Article I shall include the exclusive right of the author to make, publish and authorize the making and publication of translations of works protected under this Convention.   一、第一条所述各项权利,应包括作者翻译和授权他人翻译受本公约保护的作品,以及出版和授权他人出版上述作品译本的专有权利。
2. However, any Contracting State may, by its domestic legislation, restrict the right of translation of writings, but only subject to the following provisions:   二、然而,任何缔约国根据其国内法可以对文字作品的翻译权利加以限制;但必须遵照如下规定:
(a) If, after the expiration of a period of seven years from the date of the first publication of a writing, a translation of such writing has not been published in a language in general use in the Contracting State, by the owner of the right of translation or with his authorization, any national of such Contracting State may obtain a non-exclusive licence from the competent authority thereof to translate the work into that language and publish the work so translated.
  (一)如果一部文字作品自首次出版算起七年期满而翻译权所有者或在其授权下尚未以该缔约国通用语文出版译本,该缔约国任何国民都可从主管当局得到用该国通用语文翻译该作品并出版译本的非专有许可证。
(b) Such national shall in accordance with the procedure of the State concerned, establish either that he has requested, and been denied, authorization by the proprietor of the right to make and publish the translation, or that, after due diligence on his part, he was unable to find the owner of the right. A licence may also be granted on the same conditions if all previous editions of a translation in a language in general use in the Contracting State are out of print.
  (二)该国民须按照有关国家的现行规定,证明他根据不同情况已向翻译权所有者提出翻译和出版译本的要求,而又未能得到授权,或经过相当努力仍未能找到权利所有者。如果以缔约国通用语文翻译的以前所有版本均已售完,也可根据同样条件发给许可证。
(c) If the owner of the right of translation cannot be found, then the applicant for a licence shall send copies of his application to the publisher whose name appears on the work and, if the nationality of the owner of the right of translation is known, to the diplomatic or consular representative of the State of which such owner is a national, or to the organization which may have been designated by the government of that State. The licence shall not be granted before the expiration of a period of two months from the date of the dispatch of the copies of the application.
  (三)如申请人无法找到翻译权所有者,即应将申请书的副本寄给该作品上列有名称的出版者,如果翻译权所有者国籍业已弄清,则应将申请书的副本送交翻译权所有者所属国家的外交或领事代表,或送交该国政府指定的机构。许可证不得在寄出申请书副本后两个月期满以前发给。
(d) Due provision shall be made by domestic legislation to ensure to the owner of the right of translation a compensation which is just and conforms to international standards, to ensure payment and transmittal of such compensation, and to ensure a correct translation of the work.
  (四)国内法律应做出相应规定,以保证翻译权所有者得到公平而符合国际标准的补偿,保证这种补偿的支付和传递,并保证准确地翻译该作品。
(e) The original title and the name of the author of the work shall be printed on all copies of the published translation. The' licence shall be valid only for publication of the translation in the territory of the Contracting State where it has been applied for. Copies so published may be imported and sold in another Contracting State if a language in general use in such other State is the same language as that into which the work has been so translated, and if the domestic law in such other State makes provision for such licences and does not prohibit such importation and sale. Where the foregoing conditions do not exist, the importation and sale of such copies in a Contracting State shall be governed by its domestic law and its agreements. The licence shall not be transferred by the licensee.
  (五)凡经出版的译本复制品,均应刊印原著名称及作者姓名。许可证只适用于在申请许可证的该缔约国领土内出版译本。此种出版的复制品可以输入到另一缔约国并在其境内出售,只要该国通用语文和作品的译文是同一种语文,并且该国的法律对此种许可作出了规定,而且对进口和出售不予禁止。如无上述条件,在某缔约国进口和销售上述译本应受该国法律和协定的管制。许可证不得由被许可人转让。
(f) The licence shall not be granted when the author has withdrawn from . circulation all copies of the work.
  (六)在作者已停止全部作品复制品的发行时,不得发给任何许可证。

Article Vbis

第五条之二

1. Any Contracting State regarded as a developing country in conformity with the established practice of the General Assembly of the United Nations may, by a notification deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization (hereinafter called `the Director-General') at the time of this ratification, acceptance or accession or thereafter, avail itself of any or all of the exceptions provided for in Articles Vter and Vquater.   一、根据联合国大会惯例被视为发展中国家的任何缔约国,可在批准、接受或参加本公约时,或在以后任何日期向联合国教育科学文化组织总干事(下称总干事)提交的通知中声明,将援用第五条之三或之四中任何一条或全部例外规定。
2. Any such notification shall be effective for ten years from the date of coming into force of this Convention, or for such part of that ten-year period as remains at the date of deposit of the notification, and may be renewed in whole or in part for further periods of ten years each if, not more than fifteen or less than three months before the expiration of the relevant ten-year period, the Contracting State deposits a further notification with the Director-General. Initial notifications may also be made during these further periods of ten years in accordance with the provisions of this Article.   二、任何这种通知书自公约生效之日起十年内有效,或在提交该通知书时十年期限的所余时间内有效;如果在现行期限期满前最多十五个月最少三个月向总干事提交通知,该通知可以全部或部分地每十年顺延一次。根据本条规定,首次通知书也可在延续的十年期间提出。
3. Notwithstanding the provisions of paragraph 2, a Contracting State that has ceased to be regarded as a developing country as referred to in paragraph 1 shall no longer be entitled to renew its notification made under the provisions of paragraph 1 or 2, and whether or not it formally withdraws the notification such State shall be precluded from availing itself of the exceptions provided for in Articles Vter and Vquater at the end of the current ten-year period, or at the end of three years after it has ceased to be regarded as a developing country, whichever period expires later.   三、尽管有本条第二款的规定,任何不再被认为是第一款所指的发展中国家的缔约国,不再有资格象第一款或第二款所规定的那样延长其通知,不论它是否正式撤回其通知,该国在现行十年期限期满时,或在停止被视为发展中国家三年后即失去援用第五条之三和之四的例外规定的可能性。
4. Any copies of a work already made under the exceptions provided for in Articles Vter and Vquater may continue to be distributed after the expiration of the period for which notifications under this Article were effective until their stock is exhausted.   四、根据第五条之三和之四的例外规定而制作的作品复制品,在根据本条规定交存的通知书有效期满后,可以继续发行直到售完为止。
5. Any Contracting State that has deposited a notification in accordance with Article XIII with respect to the application of this Convention to a particular country or territory, the situation of which can be regarded as analogous to that of the States referred to in paragraph 1 of this Article, may also deposit notifications and renew them in accordance with the provisions of this Article with respect to any such country or territory. During the effective period of such notifications, the provisions of Articles Vter and Vquater may be applied with respect to such country or territory. The sending of copies from the country or territory to the Contracting State shall be considered as export within the meaning of Articles Vter and Vquater.   五、依照第十三条就使公约适用于其情况可能类似本条第一款所指国家的情况的特定国家或领地而提交通知的缔约国,或依照本条就此国家或领地提交或延长通知。在这种通知有效期间本公约第五条之三和之四的规定应适用于它所指的国家或领地。由上述国家或领地向缔约国运寄作品复制品应视为第五条之三和之四所称的出口。

Article Vter

第五条之三

1.   一、
(a) Any Contracting State to which Article Vbis (1) applies may substitute for the period of seven years provided for in Article V (2) a period of three years or any longer period prescribed by its legislation. However, in the case of a translation into a language not in general use in one or more developed countries that are party to this Convention or only the 1952 Convention, the period shall be one year instead of three.
  (一)凡适用第五条之二第一款的任何缔约国,均可以该国法律规定的三年或三年以上的期限取代第五条第二款规定的七年期限;然而,某一作品译成的文字如在一个或若干个发达国家内并非通用,而上述国家又是本公约或仅是1952年公约的缔约国,则上述期限应是一年而不是三年。
(b) A Contracting State to which Article Vbis (1) applies may, with the unanimous agreement of the developed countries party to this Convention or only the 1952 Convention and in which the same language is in general use, substitute, in the case of translation into that language, for the period of three years provided for in sub-paragraph (a) another period as determined by such agreement but not shorter than one year. However, this sub-paragraph shall not apply where the language in question is English, French or Spanish. Notification of any such agreement shall be made to the Director-General.
  (二)在通用同一种语文的本公约或仅参加1952年公约的发达国家的一致协议下,如果要译成这种语文,第五条之二第一款所提到的所有国家都可以根据该协议规定的另一期限来代替本款(一)项规定的三年期限,但不得少于一年。尽管如此,如涉及的语文为英文、法文或西班牙文,此项规定仍不适用。所有这方面的协议应通知总干事。
(c) The licence may only be granted if the applicant, in accordance with the procedure of the State concerned, establishes either that he has requested, and been denied, authorization by the owner of the right of translation, or that, after due diligence on his part, he was unable to find the owner of the right. At the same time as he makes his request he shall inform either the International Copyright Information Center established by the United Nations Educational, Scientific and Cultural Organization or any national or regional information centre which may have been designated in a notification to that effect deposited with the Director-General by the government of the State in which the publisher is believed to have his principal place of business.
  (三)许可证的发给,须经申请人按照有关国家现行规定,证明他已向翻译权所有者提出授权要求,而又未能得到,或经过相当努力仍未能找到权利所有者。在向权利所有者提出这一要求的同时,申请人还必须将这一申请通知联合国教育科学文化组织设立的国际版权情报中心,或出版者主要营业地点所在的缔约国政府交存总干事的通知书中所指定的任何国家或地区的情报中心。
(d) If the owner of the right of translation cannot be found, the applicant for a licence shall send, by registered airmail, copies of this application to the publisher whose name appears on the work and to any national or regional information center as mentioned in sub-paragraph (c). If no such center is notified he shall also send a copy to the international copyright information center established by the United Nations Educational, Scientific and Cultural Organization.
  (四)如果申请人无法找到翻译权所有者,即应通过挂号航邮将申请书的副本寄给该作品上列有名称的出版者,并同时寄给本款(三)项所述的任何国家或地区的情报中心。如无上述中心可通知,他应将申请书的抄件送交联合国教育科学文化组织设立的国际版权情报中心。
2.   二、
(a) Licences obtainable after three years shall not be granted under this Article until a further period of six months has elapsed and licences obtainable after one year until a further period of nine months has elapsed. The further period shall begin either from the date of the request for permission to translate mentioned in paragraph 1 (c) or, if the identity or address of the owner of the right of translation is not known, from the date of dispatch of the copies of the application for a licence mentioned in paragraph 1 (d).
  (一)根据本条规定三年后可获得的许可证须再过六个月后才能颁发,一年后可获得的许可证须再过九个月后才能颁发。上述六或九个月的期限应按第一款(三)项的规定,从申请许可证之日算起,如翻译权所有者的身份、地址不详,则按第一款(四)的规定从申请书的副本发出之日算起。
(b) Licences shall not be granted if a translation has been published by the owner of the right of translation or with his authorization during the said period of six or nine months.
  (二)翻译权所有者本人或授权他人在上述六个月或九个月内已将译著出版,则不得再颁发许可证。
3. Any licence under this Article shall be granted only for the purpose of teaching, scholarship or research.   三、本条所指任何许可证之颁发只限于教学、学习或研究之用。
4.   四、
(a) Any licence granted under this Article shall not extend to the export of copies and shall be valid only for publication in the territory of the Contracting State where it has been applied for.
  (一)任何根据本条发给的许可证不得扩大到作品复制品的出口,许可证只适用于在申请许可证的该国领土内出版。
(b) Any copy published in accordance with a licence granted under this Article shall bear a notice in the appropriate language stating that the copy is available for distribution only in the Contracting State granting the licence. If the writing bears the notice specified in Article III (1) the copies shall bear the same notice.
  (二)所有根据本条发给许可证出版的作品复制品均需载有有关语文的通知,说明作品复制品只能在发给许可证的缔约国内发行。如果该作品刊有第三条第一款规定的启事,其译本各册均应刊印相同的启事。
(c) The prohibition of export provided for in sub-paragraph (a) shall not apply where a governmental or other public entity of a State which has granted a licence under this Article to translate a work into a language other than English, French or Spanish sends copies of a translation prepared under such licence to another country if:
  (三)某缔约国政府机构或其他公众团体根据本条规定已颁发许可证将某作品译成除英、法、西班牙语之外的另一种文字,而当该政府机构或公众团体向另一国递送根据上述许可证而准备好的译本复制品,则不适用本款(一)项有关禁止出口的规定,如果
(i) the recipients are individuals who are nationals of the Contracting State granting the licence, or organizations grouping such individuals;
  (1)收件人为发给许可证的缔约国国民个人,或由这些国民组成的组织;
(ii) the copies are to be used only for the purpose of teaching, scholarship or research;
  (2)作品复制品只供教学、学习或研究使用;
(iii) the sending of the copies and their subsequent distribution to recipients is without the object of commercial purpose; and
  (3)作品复制品寄给收件人及其进一步分发均无任何营利性质,并且
(iv) the country to which the copies have been sent has agreed with the Contracting State to allow the receipt, distribution or both and the Director-General has been notified of such agreement by any one of the governments which have concluded it.
  (4)作品复制品寄往的国家与缔约国订有协议,批准这种作品复制品的接收或分发或两者同时批准,任何一方政府已将该协议通知总干事。
5. Due provision shall be made at the national level to ensure:   五、在国家范围内作出适当的规定,以保证
(a) that the licence provides for just compensation that is consistent with standards of royalties normally operating in the case of licences freely negotiated between persons in the two countries concerned; and
  (一)许可证之发给应给予一笔合理的报酬,此种报酬应符合有关两国个人之间自由谈判的许可证通常支付版税的标准;而且
(b) payment and transmittal of the compensation; however, should national currency regulations intervene, the competent authority shall make all efforts, by the use of international machinery, to ensure transmittal in internationally convertible currency or its equivalent.

6. Any licence granted by a Contracting State under this Article shall terminate if a translation of the work in the same language with substantially the same content as the edition in respect of which the licence was granted is published in the said State by the owner of the right of translation or with his authorization, at a price reasonably related to that normally charged in the same State for comparable works. Any copies already made before the licence is terminated may continue to be distributed until their stock is exhausted.   六、如果某作品的译本一旦由翻译权所有者本人或授权他人在某缔约国内出版发行,其文字与该国已特许的版本一样,其内容又大体相同,其价格与该国同类作品的一般索价相当,则根据本条规定由上述缔约国颁发之许可证应停止生效。在撤销许可前业已出版的作品复制品可一直发行到售完为止。
7. For works which are composed mainly of illustrations a licence to translate the text and to reproduce the illustrations may be granted only if the conditions of Article Vquater are also fulfilled.   七、对主要由图画组成的作品,其文字的翻译与图画的复制的许可证只有在第五条之四规定的条件也得到履行的情况下才能发给。
8.   八、
(a) A licence to translate a work protected under this Convention, published in printed or analogous forms of reproduction, may also be granted to a broadcasting organization having its headquarters in a Contracting State to which Article Vbis (1) applies, upon an application made in that State by the said organization under the following conditions:
  (一)对翻译一部已以印刷形式或其他类似的复制形式出版的受本公约保护的作品发给的许可证,也可根据总部设在适用第五条之二的缔约国的广播机构在该国提出的要求,发给该广播机构,但必须符合下列条件:
(i) the translation is made from a copy made and acquired in accordance with the laws of the Contracting State;
  (1)译文是根据该缔约国法律制作并获得的作品复制品翻译的;
(ii) the translation is for use only in broadcasts intended exclusively for teaching or for the dissemination of the results of specialized technical or scientific research to experts in a particular profession;
  (2)译文只能用于教学广播或向特定专业的专家传播专门技术或科学研究成果的广播;
(iii) the translation is used exclusively for the purposes set out in condition (ii), through broadcasts lawfully made which are intended for recipients on the territory of the Contracting State, including broadcasts made through the medium of sound or visual recordings lawfully and exclusively made for the purpose of such broadcasts;
  (3)译文专门为第二目所指目的使用,并通过对缔约国境内听众的合法广播进行,其中包括专为此项广播目的而通过录音或录像手段合法录制的广播;
(iv) sound or visual recordings of the translation may be exchanged only between broadcasting organizations having their headquarters in the Contracting State granting the licence; and
  (4)译文的录音或录像只能在其总部设在颁发许可证的缔约国的广播组织之间交换;
(v) all uses made of the translation are without any commercial purpose.
  (5)所有译文的使用均无任何营利性质。
(b) Provided all of the criteria and conditions set out in sub-paragraph (a) are met, a licence may also be granted to a broadcasting organization to translate any text incorporated in an audio-visual fixation which was itself prepared and published for the sole purpose of being used in connexion with systematic instructional activities.
  (二)只要符合(一)项列举的所有准则和条件,也可对广播机构颁发许可证以翻译专为大、中、小学使用而制作与出版的视听教材中的所有课文。
(c) Subject to sub-paragraphs (a) and (b), the other provisions of this Article shall apply to the grant and exercise of the licence.
  (三)在遵守本条规定的条件下,依本条颁发的任何许可证应受第五条各项规定的约束;即使在第五条第二款规定的七年期限届满后,上述许可证也应继续受第五条和本条规定的约束。但上述期限到期后,许可证持有者有权请求以仅受第五条约束的新许可证来代替上述许可证。
9. Subject to the provisions of this Article, any licence granted under this Article shall be governed by the provisions of Article V, and shall continue to be governed by the provisions of Article V and of this Article, even after the seven-year period provided for in Article V (2) has expired. However, after the said period has expired, the licensee shall be free to request that the said licence be replaced by a new licence governed exclusively by the provisions of Article V.   九、在遵守本条规定的条件下,依本条颁发的任何许可证应受第五条各项规定的约束。即使在第五条第二款规定的七年期限届满后,上述许可证也应继续受到第五条和本条规定的约束;但上述期限到期后,许可证持有者有权请求以仅受第五条约束的新许可证来代替上述许可证。

Article Vquater

第五条之四

1. Any Contracting State to which Article Vbis (1) applies may adopt the following provisions:   一、凡适用第五条之二第一款规定的任何缔约国均可采纳下述规定:
(a) If, after the expiration of 
  (一)
(i) the relevant period specified in sub-paragraph (c) commencing from the date of first publication of a particular edition of a literary, scientific or artistic work referred to in paragraph 3, or
  (1)自本条第三款所述的文学、科学或艺术作品特定版本首次出版之日算起在(三)项规定的期限期满时,或
(ii) any longer period determined by national legislation of the State;
  (2)由缔约国国家法律规定的日期算起的更长的期限期满时,
copies of such edition have not been distributed in that State to the general public or in connexion with systematic instructional activities at a price reasonably related to that normally charged in the State for comparable works, by the owner of the right of reproduction or with his authorization, any national of such State may obtain a non-exclusive licence from the competent authority to publish such edition at that or a lower price for use in connexion with systematic instructional activities. The licence may only be granted if such national, in accordance with the procedure of the State concerned, establishes either that he has requested, and been denied, authorization by the proprietor of the right to publish such work, or that, after due diligence on his part, he was unable to find the owner of the right. At the same time as he makes his request he shall inform either the international copyright information center established by the United Nations Educational, Scientific and Cultural Organization or any national or regional information center referred to in sub-paragraph (d).
若该版的作品复制品尚无复制权所有者或在其授权下,以与同类作品在该国通行的价格相似的价格在该国出售,以满足广大公众或大、中、小学教学之需要,则该国任何国民均可向主管当局申请得到非专有许可证,以此种价格或更低价格复制和出版该版本供大、中、小学教学之用。许可证的发给,须经国民按照该国现行规定,证明他已向权利所有者提出出版作品的要求,而又未能得到授权,或经过相当努力仍未能找到权利所有者。在向权利所有者提出这一要求的同时,申请人还必须将这一申请通知联合国教育科学文化组织设立的国际版权情报中心,或(四)项所述的任何国家或地区的情报中心。
(b) A licence may also be granted on the same conditions if, for a period of six months, no authorized copies of the edition in question have been on sale in the State concerned to the general public or in connexion with systematic instructional activities at a price reasonably related to that normally charged in the State for comparable works.
  (二)根据同样的条件,也可发给许可证,如果经权利所有者授权制作的该版作品复制品在该国已脱销六个月,而无法以同该国内对同类作品要求的价格相似的价格供应广大公众或供大、中、小学教学之用。
(c) The period referred to in sub-paragraph (a) shall be five years except that:
  (三)本款(一)项所指的期限为五年。但
(i) for works of the natural and physical sciences, including mathematics, and of technology, the period shall be three years;
  (1)对有关数学和自然科学以及技术的作品,则为三年;
(ii) for works of fiction, poetry, drama and music, and for art books, the period shall be seven years.
  (2)小说、诗歌、戏剧和音乐作品以及美术书籍,则为七年。
(d) If the owner of the right of reproduction cannot be found, the applicant for a licence shall send, by registered air mail, copies of his application to the publisher whose name appears on the work and to any national or regional information centre identified as such in a notification deposited with the Director-General by the State in which the publisher is believed to have his principal place of business. In the absence of any such notification, he shall also send a copy to the international copyright information center established by the United Nations Educational, Scientific and Cultural Organization. The licence shall not be granted before the expiration of a period of three months from the date of dispatch of the copies of the application.
  (四)如果申请人无法找到复制权所有者,即应通过挂号航邮将申请书的副本,寄给该作品上列有名称的出版者和据信为出版者主要业务中心所在国的政府为此目的向总干事递交的通知中所指定的任何国内或国际情报中心。如无上述通知书,他应将申请书的抄件递交联合国教育科学文化组织设立的国际情报中心。在发出申请书抄件之日起三个月内不得颁发许可证。
(e) Licences obtainable after three years shall not be granted under this Article:
  (五)在下述情况下,不得按本条规定颁发三年后可获得的许可证:
(i) until a period of six months has elapsed from the date of the request for permission referred to in sub-paragraph (a) or, if the identity or address of the owner of the right of reproduction is unknown, from the date of the dispatch of the copies of the application for a licence referred to in sub-paragraph (d);
  (1)从本款(一)项所述的申请许可证之日算起未满六个月者,或如果复制权所有者的身份或地址不明,则从本款(四)项所述的申请书的副本发出之日起未满六个月者;
(ii) if any such distribution of copies of the edition as is mentioned in sub-paragraph (a) has taken place during that period.
  (2)如果在此期间本款(一)项所述的版本的作品复制品已开始发行。
(f) The name of the author and the title of the particular edition of the work shall be printed on all copies of the published reproduction. The licence shall not extend to the export of copies and shall be valid only for publication in the territory of the Contracting State where it has been applied for. The licence shall not be transferable by the licensee.
  (六)作者姓名及其作品原版的标题应刊印在复制出版的所有作品复制品上。许可证持有者不得转让其许可证。
(g) Due provision shall be made by domestic legislation to ensure an accurate reproduction of the particular edition in question.
  (七)应通过国家法律采取适当措施,以保证作品原版的准确复制。
(h) A licence to reproduce and publish a translation of a work shall not be granted under this Article in the following cases:
  (八)在下列情况下不得根据本条发给复制和出版一部作品的译本许可证。
(i) where the translation was not published by the owner of the right of translation or with his authorization;
  (1)所涉及的译本并非由翻译权所有者或在其授权下出版;
(ii) where the translation is not in a language in general use in the State with power to grant the licence.
  (2)译本所用的不是有权颁发许可证的国家的通用语文。
2. The exceptions provided for in paragraph 1 are subject to the following additional provisions:   二、第一款的例外规定应受下述补充规定的约束:
(a) Any copy published in accordance with a licence granted under this Article shall bear a notice in the appropriate language stating that the copy is available for distribution only in the Contracting State to which the said licence applies. If the edition bears the notice specified in Article III (1), the copies shall bear the same notice.
  (一)所有根据本条发给许可证出版的作品复制品均需载有有关语文的通知,说明该作品复制品只能在该许可证适用的缔约国内发行。如果该版本载有第三条第一款规定的启事,则该版本的所有各册均应刊印相同的启事。
(b) Due provision shall be made at the national level to ensure:
  (二)在国家范围内做出适当的规定,以保证
(i) that the licence provides for just compensation that is consistent with standards of royalties normally operating in the case of licences freely negotiated between persons in the two countries concerned; and
  (1)许可证之发给应给一笔合理的报酬,此种报酬应符合有关两国个人之间自由谈判的许可证通常支付版税的标准;而且
(ii) payment and transmittal of the compensation; however, should national currency regulations intervene, the competent authority shall make all efforts, by the use of international machinery, to ensure transmittal in internationally convertible currency or its equivalent.
  (2)保证这笔报酬的支付和转递;如果存在着国家对外汇的管制,则主管当局应通过国际机构,尽一切努力保证使这笔报酬以国际上可兑换的货币或其等值货币转递。
(c) Whenever copies of an edition of a work are distributed in the Contracting State to the general public or in connexion with systematic instructional activities, by the owner of the right of reproduction or with his authorization, at a price reasonably related to that normally charged in the, State for comparable works, any licence granted under this Article shall terminate if such edition is in the same language and is substantially the same in content as the edition published under the licence. Any copies already made before the licence is terminated may continue to be distributed until their stock is exhausted.
  (三)如果某一作品某版的复制品是由复制权所有者或经其授权以同该国同类作品相似的价格,为供应广大公众或为大、中、小学教学之用而在该缔约国内出售,而该版的语文和基本内容又同根据许可证出版的版本语文和内容相同,则应撤销本条发给的许可证。在撤销许可证前业已制作的作品复制品可一直发行到售完为止。
(d) No licence shall be granted when the author has withdrawn from circulation all copies of the edition in question.
  (四)在作者已停止该版的全部作品复制品的发行时,不得发给任何许可证。
3.   三、
(a) Subject to sub-paragraph (b), the literary, scientific or artistic works to which this Article applies shall be limited to works published in printed or analogous forms of reproduction.
  (一)除(二)项规定的情况外,本条适用的文学、科学或艺术作品只限于以印刷形式或任何其他类似的复制形式出版的作品。
(b) The provisions of this Article shall also apply to reproduction in audio-visual form of lawfully made audio-visual fixations including any protected works incorporated therein and to the translation of any incorporated text into a language in general use in the State with power to grant the licence; always provided that the audio-visual fixations in question were prepared and published for the sole purpose of being used in connexion with systematic instructional activities.
  (二)本条同样适用于以视听形式合法复制的受保护作品或包含受保护作品的视听资料,以及用有权颁发许可证的缔约国通用语文翻译的该视听资料中的文学部分的译本,条件是所涉及的视听资料的制作和出版限大、中、小学教学使用的唯一目的。

Article VI

第六条

“Publication”, as used in this Convention, means the reproduction in tangible form and the general distribution to the public of copies of a work from which it can be read or otherwise visually perceived.   本公约所用“出版”一词,系指以有形形式复制,并向公众发行的能够阅读或可看到的作品复制品。

Article VII

第七条

This Convention shall not apply to works or rights in works which, at the effective date of this Convention in a Contracting State where protection is claimed, are permanently in the public domain in the said Contracting State.   本公约不适用于公约在被要求给予保护的缔约国家生效之日已完全丧失保护或从未受过保护的作品或作品的权利。

Article VIII

第八条

1. This Convention, which shall bear the date of 24 July 1971, shall be deposited with the Director-General and shall remain open for signature by all States party to the 1952 Convention for a period of 120 days after the date of this Convention. It shall be subject to ratification or acceptance by the signatory States.   一、本公约的修订日期为1971年7月24日,它应交由总干事保存,并应在上述日期起的一百二十天内向1952年公约的所有参加国开放签字。本公约须经各签字国批准或接受。
2. Any State which has not signed this Convention may accede thereto.   二、未在本公约上签字的国家均可加入。
3. Ratification, acceptance or accession shall be effected by the deposit of an instrument to that effect with the Director-General.   三、批准、接受或加入本公约须向总干事交存有关文件方为有效。

Article IX

第九条

1. This Convention shall come into force three months after the deposit of twelve instruments of ratification, acceptance or accession.   一、本公约将于交存十二份批准、接受或加入证书之后三个月生效。
2. Subsequently, this Convention shall come into force in respect of each State three months after that State has deposited its instrument of ratification, acceptance or accession.   二、其后,本公约将对每个国家在其交存批准、接受或加入证书三个月后生效。
3. Accession to this Convention by a State not party to the 1952 Convention shall also constitute accession to that Convention; however, if its instrument of accession is deposited before this Convention comes into force, such State may make its accession to the 1952 Convention conditional upon the coming into force of this Convention. After the coming into force of this Convention, no State may accede solely to the 1952 Convention.   三、加入本公约的任何国家,如未加入1952年公约,也应被视为加入了该公约;但是,如果交存其加入证书是在本公约生效之前,则该国加入1952年公约须以本公约生效为条件。在本公约生效后,任何国家均不得只加入1952年公约。
4. Relations between States party to this Convention and States that are party only to the 1952 Convention, shall be governed by the 1952 Convention. However, any State party only to the 1952 Convention may, by a notification deposited with the Director-General, declare that it will admit the application of the 1971 Convention to works of its nationals or works first published in its territory by all States party to this Convention. '   四、本公约参加国与只参加1952年公约的国家之间的关系,应服从1952年公约的规定。但是,只参加1952年公约的任何国家,可向总干事交存通知书,宣布承认1971年公约适用于该国国民的作品和在该国首次出版的本公约签字国的作品。

Article X

第十条

1. Each Contracting State undertakes to adopt, in accordance with its Constitution, such measures as are necessary to ensure the application of this Convention.   一、所有缔约国承诺根据其宪法采取必要措施保证本公约的实施。
2. It is understood that at the date this Convention comes into force in respect of any State, that State must be in a position under its domestic law to give effect to the terms of this Convention.   二、不言而喻,本公约在任何缔约国生效时,应按照其本国法律使本公约的规定付诸实施。

Article XI

第十一条

1. An Intergovernmental Committee is hereby established with the following duties:   一、设立一“政府间委员会”,其职责如下:
(a) to study the problems concerning the application and operation of the Universal Copyright Convention;
  (一)研究世界版权公约的适用和实施事宜;
(b) to make preparation for periodic revisions of this Convention;
  (二)做好定期修订本公约的准备工作;
(c) to study any other problems concerning the international protection of copyright, in co-operation with the various interested international organizations, such as the United Nations Educational, Scientific and Cultural Organization, the International Union for the Protection of Literary and Artistic Works and the Organization of American States;
  (三)与“联合国教育科学文化组织”、“国际保护文学艺术作品联盟”、“美洲国家组织”等各有关国际组织合作,研究有关国际保护版权的任何问题;
(d) to inform States party to the Universal Copyright Convention as to its activities.
  (四)将“政府间委员会”的各项活动通知世界版权公约的参加国。
2. The Committee shall consist of the representatives of eighteen States party to this Convention or only to the 1952 Convention.   二、该委员会将由参加本公约或只参加1952年公约的十八个国家的代表组成。
3. The Committee shall be selected with due consideration to a fair balance of national interests on the basis of geographical location, population, languages and stage of development.   三、该委员会成员的选择应根据各国的地理位置、人口、语文和发展水平,适当考虑到各国利益的均衡。
4. The Director-General of the United Nations Educational, Scientific and Cultural Organization, the Director-General of the World Intellectual Property Organization and the Secretary-General of the Organization of American States, or their representatives, may attend meetings of the Committee in an advisory capacity.   四、联合国教育科学文化组织总干事、世界知识产权组织总干事和美洲国家组织秘书长的代表可以顾问身份参加该委员会的会议。

Article XII

第十二条

The Intergovernmental Committee shall convene a conference for revision whenever it deems necessary, or at the request of at least ten States party to this Convention.   政府间委员会认为必要时,或经本公约至少十个缔约国的要求,得召集会议对本公约进行修改。

Article XIII

第十三条

1. Any Contracting State may, at the time of deposit of its instrument of ratification, acceptance or accession, or at any time thereafter, declare by notification addressed to the Director-General that this Convention shall apply to all or any of the countries or territories for the international relations of which it is responsible and this Convention shall thereupon apply to the countries or territories named in such notification after the expiration of the term of three months provided for in Article IX. In the absence of such notification, this Convention shall not apply to any such country or territory.   一、任何缔约国,在交存其批准,接受或加入证书时,或在其后的任何时间内,可在致总干事的通知书中,宣布本公约适用于由它对其国际关系负责的所有国家或领地,或其中任何一个国家或领地;因此,本公约于第九条规定的三个月期限期满后,将适用于通知书中提到的国家或领地。倘无此类通知书,本公约将不适用于此类国家或领地。
2. However, nothing in this Article shall be understood as implying the recognition or tacit acceptance by a Contracting State of the factual situation concerning a country or territory to which this Convention is made applicable by another Contracting State in accordance with the provisions of this Article.   二、但是,本条款不得理解为某一缔约国承认或默认另一缔约国根据本条规定使本公约对之适用的国家或领地的事实状况。

Article XIV

第十四条

1. Any Contracting State may denounce this Convention in its own name or on behalf of all or any of the countries or territories with respect to which a notification has been given under Article XIII. The denunciation shall be made by notification addressed to the Director-General. Such denunciation shall also constitute denunciation of the 1952 Convention.   一、任何缔约国可以自己的名义、或代表根据第十三条规定发出的通知书所涉及的所有或其中一个国家或领地,废除本公约。废除本公约应以通知书方式寄交总干事。此种废除也构成对1952年公约的废除。
2. Such denunciation shall operate only in respect of the State or of the country or territory on whose behalf it was made and shall not take effect until twelve months after the date of receipt of the notification.   二、此种废除只对有关的缔约国或其所代表的国家或领地有效,并应于收到通知书之日起十二个月后生效。

Article XV

第十五条

A dispute between two or more Contracting States concerning the interpretation or application of this Convention, not settled by negotiation, shall, unless the States concerned agree on some other method of settlement, be brought before the International Court of Justice for determination by it.   两个或两个以上缔约国在解释或适用本公约方面发生的争端,经谈判不能解决时,如果有关国家不能就其他解决办法达成协议,应将争议提交国际法院裁决。

Article XVI

第十六条

1. This Convention shall be established in English, French and Spanish. The three texts shall be signed and shall be equally authoritative.   一、本公约用英文、法文和西班牙文三种文字制定,三种文本应予签署并具有同等效力。
2. Official texts of this Convention shall be established by the Director-General, after consultation with the governments concerned, in Arabic, German, Italian and Portuguese.   二、总干事在和有关政府协商后,将制定阿拉伯文、德文、意大利文和葡萄牙文的正式文本。
3. Any Contracting State or group of Contracting States shall be entitled to have established by the Director-General other texts in the language of its choice by arrangement with the Director-General.   三、某个或数个缔约国有权与总干事协商后由总干事制定它们选择的语文的其他文本。
4. All such texts shall be annexed to the signed texts of this Convention.   四、所有这些文本均附在本公约签字文本之后。

Article XVII

第十七条

1. This Convention shall not in any way affect the provisions of the Berne Convention for the Protection of Literary and Artistic Works or membership in the Union created by that Convention.   一、本公约绝不影响伯尔尼保护文学艺术作品公约的条款或由该公约设立的联盟的会员资格。
2. In application of the foregoing paragraph, a declaration has been annexed to the present Article. This declaration is an integral part of this Convention for the States bound. by the Berne Convention on 1 January 1951, or which have or may become bound to it at a later date. The signature of this Convention by such States shall also constitute signature of the said declaration, and ratification, acceptance or accession by such States shall include the declaration, as well as this Convention.   二、为实施前款规定,本条附有一项声明。对于在1951年1月1日受伯尔尼公约约束的各国或已受或在以后某一日期可能受该公约约束的国家,此声明是本公约的组成部分。这些国家在本公约上签字也应视为在该声明上签字,而这些国家的批准、接受或加入本公约应包括该声明。

Article XVIII

第十八条

This Convention shall not abrogate multilateral or bilateral copyright conventions or arrangements that are or may be in effect exclusively between two or more American Republics. In the event of any difference either between the provisions of such existing conventions or arrangements and the provisions of this Convention, or between the provisions of this Convention and those of any new convention or arrangement which may be formulated between two or more American Republics after this Convention comes into force, the convention or arrangement most recently formulated shall prevail between the parties thereto. Rights in works acquired in any Contracting State under existing conventions or arrangements before the date this Convention comes into force in such` State shall not be affected.   本公约将不废除美洲各共和国中仅限两国或数国之间现在有效或可能生效的多边或双边版权公约或协定。无论在现有的此类公约或协定生效的条款与本公约的条款之间,或在本公约的条款与本公约生效之后美洲两个或数个共和国可能制定的新公约或协定的条款之间出现分歧时,应以最近制定的公约或协定为准。任何缔约国在本公约生效前,对该国依据现有公约或协定所获得的版权不应受到影响。

Article XIX

第十九条

This Convention shall not abrogate multilateral or bilateral conventions or arrangements in effect between two or more Contracting States. In the event of any difference between the provisions of such existing conventions or arrangements and the provisions of this Convention, the provisions of this Convention shall prevail. Rights in works acquired in any Contracting State under existing conventions or arrangements before the date on which this Convention comes into force in such State shall not be affected. Nothing in this Article shall affect the provisions of Articles XVII and XVIII.   本公约将不废除在两上或数个缔约国之间有效的多边或双边公约或协定。一旦此类现有公约或协定的条款与本公约的条款出现分歧时,将以本公约的条款为准。任何缔约国于本公约在该国生效前,依据现有公约或协定所获得的版权将不受影响,本条规定将不影响第十七条、第十八条各款的实行。

Article XX

第二十条

Reservations to this Convention shall not be permitted.   对本公约不得有任何保留。

Article XXI

第二十一条

1. The Director-General shall send duly certified copies of this Convention to the States interested and to the Secretary-General of the United Nations for registration by him.   一、总干事应将本公约的核证无误的副本送交各有关国家并送交联合国秘书长登记。
2. He shall also inform all interested States of the ratifications, acceptances and accessions which have been deposited, the date on which this Convention comes into force, the notifications under this Convention and denunciations under Article XIV.   二、总干事还应将已交存的批准、接受和加入证书,本公约的生效日期,根据本公约发出的通知书及根据第十四条做出的废除,通知所有有关国家。

The States which are members of the International Union for the Protection of Literary and Artistic Works (hereinafter called `the Berne Union') and which- are signatories to this Convention,   国际保护文学艺术作品联盟(以下称“伯尔尼联盟”)的会员国和本公约的签字国,
Desiring to reinforce their mutual relations on the basis of the said Union and to avoid any conflict which might result from the co-existence of the Berne Convention and the Universal Copyright Convention,   为了在该联盟基础上加强其相互关系,并避免在伯尔尼公约和世界版权公约并存的情况下可能出现的任何冲突,
Recognizing the temporary need of some States to adjust their level of copyright protection in accordance with their stage of cultural, social and economic development,   认识到某些国家按照其文化、社会和经济发展阶段而调整其版权保护水平的暂时需要,
Have, by common agreement, accepted the terms of the following declaration:   经共同商定,接受以下声明的各项规定:
(a) Except as provided by paragraph (b), works which, according to the Berne Convention, have as their country of origin a country which has withdrawn from the Berne Union after 1 January 1951, shall not be protected by the Universal Copyright Convention in the countries of the Berne Union;
  (一)除本声明(二)项规定外,某作品起源国为伯尔尼公约成员国的国家,已于1951年1月1日之后退出伯尔尼联盟者,将不得在伯尔尼联盟的国家境内受到世界版权公约的保护。
(b) Where a Contracting State is regarded as a developing country in conformity with the established practice of the General Assembly of the United Nations, and has deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization, at the time of its withdrawal from the Berne Union, a notification to the effect that it regards itself as a developing country, the provisions of paragraph (a) shall not be applicable as long as such State may avail itself of the exceptions provided for by this Convention in accordance with Article Vbis;
  (二)如某一缔约国按联合国大会确定的惯例被视为发展中的国家,并在该国退出伯尔尼联盟时,将一份它认为自己是发展中国家的通知书交存联合国教育科学文化组织总干事,只要该国可以援用本公约第五条之二的例外规定,则本声明(一)项的规定不应适用。
(c) The Universal Copyright Convention shall not be applicable to the relationships among countries of the Berne Union in so far as it relates to the protection of works having as their country of origin, within the meaning of the Berne Convention, a country of the Berne Union.
  (三)只要涉及到所保护的某些作品,按伯尔尼公约规定,其原出版国家是伯尔尼联盟的一个成员国,世界版权公约即不应适用于伯尔尼联盟各国的关系上。

Resolution concerning Article XI

有关第十一条的决议

The Conference for Revision of the Universal Copyright Convention,   修订世界版权公约会议,
Having considered the problems relating to the Intergovernmental Committee provided for in Article XI of this Convention, to which this resolution is annexed,   考虑了本公约第十一条规定的政府间委员会的问题,对此附加了本决议,
Resolves that:   特决议如下:
1. At its inception, the Committee shall include representatives of the twelve States members of the Intergovernmental Committee established under Article XI of the 1952 Convention and the resolution annexed to it, and, in addition, representatives of the following States: Algeria, Australia, Japan, Mexico, Senegal and Yugoslavia.   一、委员会创始时应包括依1952年公约第十一条及其所附的决议而设立的政府间委员会的十二个成员国的代表;此外,还包括以下国家的代表:阿尔及利亚、澳大利亚、日本、墨西哥、塞内加尔和南斯拉夫。
2. Any States that are not party to the 1952 Convention and have not acceded to this Convention before the first ordinary session of the Committee following the entry into force of this Convention shall be replaced by other States to be selected by the Committee at its first ordinary session in conformity with the provisions of Article XI (2) and (3).   二、任何未参加1952年公约并在本公约生效后召开的本委员会第一次例会之前未加入本公约的国家,应由委员会根据第十一条第二款和第三款的规定在其第一次例会上选择的其他国家来取代。
3. As soon as this Convention comes into force the Committee as provided for in paragraph 1 shall be deemed to be constituted in accordance with Article XI of this Convention.   三、本公约一经生效,依本决议第一款成立的本委员会应被认为按本公约第十一条规定组成。
4. A session of the Committee shall take place within one year after the coming into force of this Convention; thereafter the Committee shall meet in ordinary session at intervals of not more than two years.   四、本公约生效后一年内,委员会应举行一次会议。此后委员会应至少每两年举行一次例会。
5. The Committee shall elect its Chairman and'-two Vice-Chairmen. It shall establish its Rules of Procedure having regard to the following principles:   五、委员会应选举主席一人、副主席两人。并应按照下列原则确立自己的程序规则:
(a) The normal duration of the term of office of the members represented on the Committee shall be six years with one-third retiring every two years, it being however understood that, of the original terms of office, one-third shall expire at the end of the Committee's second ordinary session which will follow the entry into force of this Convention, a further third at the end of its third ordinary session, and the remaining third at the end of its fourth ordinary session.
  (一)委员会的成员国任期通常应为六年,每两年有三分之一成员国离任,但经理解:首批三分之一成员国的任期,应在本公约生效后召开的第二次例会结束时终止,下一批三分之一成员国的任期应在第三次例会结束时终止,最后一批三分之一成员国的任期应在第四次例会结束时终止。
(b) The rules governing the procedure whereby the Committee shall fill vacancies, the order in which terms of membership expire, eligibility for re-election, and election procedures, shall be based upon a balancing of the needs for continuity of membership and rotation of representation, as well as the considerations set out in Article XI (3).
  (二)委员会递补空缺职位的程序、成员资格期满的次序连任资格和选举程序的规则应以平衡成员国连任的需要和成员国代表轮换的需要,以及本公约第十一条第三款的各点考虑为基础。

The States party hereto, being also party to the Universal Copyright Convention as revised at Paris on 24 July 1971 (hereinafter called “the 1971 Convention”),   本议定书及《世界版权公约》1971年7月24日巴黎修订本(下称1971年公约)各参加国,
Have accepted the following provisions:   承认下述各项规定:
1. Stateless persons and refugees who have their habitual residence in a State party to this Protocol shall, for the purposes of the 1971 Convention, be assimilated to the nationals of that State.   一、为实施1971年公约,应将通常居住在本议定书参加国的无国籍人士及流亡人士视为该国国民。
2.   二、
(a) This Protocol shall be signed and shall be subject to ratification or acceptance, or may be acceded to, as if the provisions of Article VIII of the 1971 Convention applied hereto.
  (一)本议定书须经签署,并须经批准或接受,也可加入,如同1971年公约第八条所规定那样。
(b) This Protocol shall enter into force in respect of each State, on the date of deposit of the instrument of ratification, acceptance or accession of the State concerned or on the date of entry into force of the 1971 Convention with respect to such State, whichever is the later.
  (二)本议定书于有关国家交存批准、接受或加入证书之日起对各该国生效,或于1971年公约对各该国生效之日起生效,以两个日期中何者在后为准。
(c) On the entry into force of this Protocol in respect of a State not party to Protocol 1 annexed to the 1952 Convention, the latter Protocol shall be deemed to enter into force in respect of such State.
  (三)对于本议定书的生效,如果一个国家不是1952年公约的附件《议定书之一》的缔约国,新版本的议定书也应被视为在该国生效。

(a) The protection provided for in Article II (1) of the 1971 Convention shall apply to works published for the first time by the United Nations, by the Specialized Agencies in relationship therewith, or by the Organization of American States.
  (一)1971年公约第二条第一款规定的版权保护,适用于联合国、联合国所属各专门机构或美洲国家组织首次出版的作品。
(b) Similarly, Article II (2) of the 1971 Convention shall apply to the said organization or agencies.
  (二)1971年公约第二条第二款同样地适用于上述组织或机构。
2.   二、
(a) This Protocol shall be signed and shall be subject to ratification or acceptance, or may be acceded to, as if the provisions of Article VIII of the 1971 Convention applied hereto.
  (一)本议定书须经签署,并须经批准或接受,也可加入,如同1971年公约第八条所规定那样。
(b) This Protocol shall enter into force for each State on the date of deposit of the instrument of ratification, acceptance or accession of the State concerned or on the date of entry into force of the 1971 Convention with respect to such State, whichever is the later.
