Preamble

序言

The Contracting Parties, 缔约各方,
Desiring to develop and maintain the protection of the rights of performers in their audiovisual performances in a manner as effective and uniform as possible,
  出于以尽可能有效和一致的方式发展和维护保护表演者对其视听表演的权利的愿望,
Recalling the importance of the Development Agenda recommendations, adopted in 2007 by the General Assembly of the Convention Establishing the World Intellectual Property Organization (WIPO), which aim to ensure that development considerations form an integral part of the Organization's work,
  回顾《建立世界知识产权组织(WIPO)公约》大会2007年所通过的旨在确保发展方面的考虑构成本组织工作的组成部分的发展议程各项建议的重要性,
Recognizing the need to introduce new international rules in order to provide adequate solutions to the questions raised by economic, social, cultural and technological developments,
  承认有必要采用新的国际规则,以提供解决由经济、社会、文化和技术发展所提出的问题的适当方法,
Recognizing the profound impact of the development and convergence of information and communication technologies on the production and use of audiovisual performances,
  承认信息与通信技术的发展和交汇对视听表演的制作与使用的深刻影响,
Recognizing the need to maintain a balance between the rights of performers in their audiovisual performances and the larger public interest, particularly education, research and access to information,
  承认有必要保持表演者对其视听表演的权利与广大公众的利益,尤其是教育、研究和获得信息的利益之间的平衡,
Recognizing that the WIPO Performances and Phonograms Treaty (WPPT) done in Geneva on December 20, 1996, does not extend protection to performers in respect of their performances fixed in audiovisual fixations,

Article 1
Relation to Other Conventions and Treaties

第一条
与其他公约和条约的关系

(1) Nothing in this Treaty shall derogate from existing obligations that Contracting Parties have to each other under the WPPT or the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done in Rome on October 26, 1961.   一、本条约的任何内容均不得减损缔约方相互之间依照《世界知识产权组织表演和录音制品条约》或依照1961年10月26日在罗马签订的《保护表演者、录音制品制作者和广播组织国际公约》已承担的现有义务。
(2) Protection granted under this Treaty shall leave intact and shall in no way affect the protection of copyright in literary and artistic works. Consequently, no provision of this Treaty may be interpreted as prejudicing such protection.   二、依本条约给予的保护不得触动或以任何方式影响对文学和艺术作品版权的保护。因此,本条约的任何内容均不得被解释为损害此种保护。
(3) This Treaty shall not have any connection with treaties other than the WPPT, nor shall it prejudice any rights and obligations under any other treaties [1][2].   三、除《世界知识产权组织表演和录音制品条约》之外,本条约不得与任何其他条约有任何关联,亦不得损害任何其他条约所规定的任何权利和义务[1][2]

Article 2
Definitions

第二条
定义

For the purposes of this Treaty:   在本条约中:
(a) "performers" are actors, singers, musicians, dancers, and other persons who act, sing, deliver, declaim, play in, interpret, or otherwise perform literary or artistic works or expressions of folklore [3];
  (一)“表演者”系指演员、歌唱家、音乐家、舞蹈家以及对文学或艺术作品或民间文学艺术表达进行表演、歌唱、演说、朗诵、演奏、表现或以其他方式进行表演的其他人员[3]
(b) "audiovisual fixation" means the embodiment of moving images, whether or not accompanied by sounds or by the representations thereof, from which they can be perceived, reproduced or communicated through a device [4];
  (二)“视听录制品”系指活动图像的体现物,不论是否伴有声音或声音表现物,从中通过某种装置可感觉、复制或传播该活动图像[4]
(c) "broadcasting" means the transmission by wireless means for public reception of sounds or of images or of images and sounds or of the representations thereof; such transmission by satellite is also "broadcasting"; transmission of encrypted signals is "broadcasting" where the means for decrypting are provided to the public by the broadcasting organization or with its consent;
  (三)“广播”系指以无线方式的传送,使公众能接收声音或图像,或图像和声音,或图像和声音的表现物;通过卫星进行的此种传送亦为“广播”;传送密码信号,只要广播组织或经其同意向公众提供了解码的手段,即为“广播”;
(d) "communication to the public" of a performance means the transmission to the public by any medium, otherwise than by broadcasting, of an unfixed performance, or of a performance fixed in an audiovisual fixation. For the purposes of Article 11, "communication to the public" includes making a performance fixed in an audiovisual fixation audible or visible or audible and visible to the public.
  (四)“向公众传播”表演系指通过除广播以外的任何媒体向公众传送未录制的表演或以视听录制品录制的表演。在第十一条中,“向公众传播”包括使公众能听到或看到,或能听到并看到以视听录制品形式录制的表演。

Article 3
Beneficiaries of Protection

第三条
保护的受益人

(1) Contracting Parties shall accord the protection granted under this Treaty to performers who are nationals of other Contracting Parties.   一、缔约各方应将本条约规定的保护给予系其他缔约方国民的表演者。
(2) Performers who are not nationals of one of the Contracting Parties but who have their habitual residence in one of them shall, for the purposes of this Treaty, be assimilated to nationals of that Contracting Party.   二、非缔约方国民但在一个缔约方境内有惯常居所的表演者,在本条约中视同该缔约方的国民。

Article 4
National Treatment

第四条
国民待遇

(1) Each Contracting Party shall accord to nationals of other Contracting Parties the treatment it accords to its own nationals with regard to the exclusive rights specifically granted in this Treaty and the right to equitable remuneration provided for in Article 11 of this Treaty.   一、在本条约所专门授予的专有权以及本条约第十一条所规定的获得合理报酬的权利方面,每一缔约方均应将其给予本国国民的待遇给予其他缔约方的国民。
(2) A Contracting Party shall be entitled to limit the extent and term of the protection accorded to nationals of another Contracting Party under paragraph (1), with respect to the rights granted in Article 11(1) and 11(2) of this Treaty, to those rights that its own nationals enjoy in that other Contracting Party.   二、在本条约第十一条第一款和第十一条第二款授予的权利方面,缔约方应有权将其依本条第一款给予另一缔约方国民的保护限制在其本国国民在该另一缔约方享有的那些权利的范围和期限之内。
(3) The obligation provided for in paragraph (1) does not apply to a Contracting Party to the extent that another Contracting Party makes use of the reservations permitted by Article 11(3) of this Treaty, nor does it apply to a Contracting Party, to the extent that it has made such reservation.   三、如果另一缔约方使用了本条约第十一条第三款允许的保留,本条第一款规定的义务对缔约方不再适用;如果某一缔约方作出了此种保留,本条第一款规定的义务也不适用于该缔约方。

Article 5
Moral Rights

第五条
精神权利

(1) Independently of a performer's economic rights, and even after the transfer of those rights, the performer shall, as regards his live performances or performances fixed in audiovisual fixations, have the right:   一、不依赖于表演者的经济权利,甚至在这些权利转让之后,表演者仍应对于其现场表演或以视听录制品录制的表演有权:
(i) to claim to be identified as the performer of his performances, except where omission is dictated by the manner of the use of the performance; and
  (1)要求承认其系表演的表演者,除非因使用表演的方式而决定可省略不提其系表演者;以及
(ii) to object to any distortion, mutilation or other modification of his performances that would be prejudicial to his reputation, taking due account of the nature of audiovisual fixations.
  (2)反对任何对其表演进行的将有损其声誉的歪曲、篡改或其他修改,但同时应对视听录制品的特点予以适当考虑。
(2) The rights granted to a performer in accordance with paragraph (1) shall, after his death, be maintained, at least until the expiry of the economic rights, and shall be exercisable by the persons or institutions authorized by the legislation of the Contracting Party where protection is claimed. However, those Contracting Parties whose legislation, at the moment of their ratification of or accession to this Treaty, does not provide for protection after the death of the performer of all rights set out in the preceding paragraph may provide that some of these rights will, after his death, cease to be maintained.   二、根据本条第一款授予表演者的权利在其死亡后应继续保留,至少到其经济权利期满为止,并可由被要求提供保护的缔约方立法所授权的个人或机构行使。但批准或加入本条约时其立法尚未规定在表演者死亡后保护上款所述全部权利的国家,则可规定其中部分权利在表演者死亡后不再保留。
(3) The means of redress for safeguarding the rights granted under this Article shall be governed by the legislation of the Contracting Party where protection is claimed [5].   三、为保障本条所授予的权利而采取的补救方法应由被要求提供保护的缔约方立法规定[5]

Article 6
Economic Rights of Performers in their Unfixed Performances

第六条
表演者对其尚未录制的表演的经济权利

Performers shall enjoy the exclusive right of authorizing, as regards their performances:   表演者应享有专有权,对于其表演授权:
(i) the broadcasting and communication to the public of their unfixed performances except where the performance is already a broadcast performance; and
  (1)广播和向公众传播其尚未录制的表演,除非该表演本身已属广播表演;和
(ii) the fixation of their unfixed performances.
  (2)录制其尚未录制的表演。

Article 7
Right of Reproduction

第七条
复制权

Performers shall enjoy the exclusive right of authorizing the direct or indirect reproduction of their performances fixed in audiovisual fixations, in any manner or form [6].   表演者应享有授权以任何方式或形式对其以视听录制品录制的表演直接或间接地进行复制的专有权[6]

Article 8
Right of Distribution

第八条
发行权

(1) Performers shall enjoy the exclusive right of authorizing the making available to the public of the original and copies of their performances fixed in audiovisual fixations through sale or other transfer of ownership.   一、表演者应享有授权通过销售或其他所有权转让形式向公众提供其以视听录制品录制的表演的原件或复制品的专有权。
(2) Nothing in this Treaty shall affect the freedom of Contracting Parties to determine the conditions, if any, under which the exhaustion of the right in paragraph (1) applies after the first sale or other transfer of ownership of the original or a copy of the fixed performance with the authorization of the performer [7].   二、对于已录制表演的原件或复制品经表演者授权被首次销售或其他所有权转让之后适用本条第一款中权利的用尽所依据的条件(如有此种条件),本条约的任何内容均不得影响缔约各方确定该条件的自由[7]

Article 9
Right of Rental

第九条
出租权

(1) Performers shall enjoy the exclusive right of authorizing the commercial rental to the public of the original and copies of their performances fixed in audiovisual fixations as determined in the national law of Contracting Parties, even after distribution of them by, or pursuant to, authorization by the performer.   一、表演者应享有授权按缔约各方国内法中的规定将其以视听录制品录制的表演的原件和复制品向公众进行商业性出租的专有权,即使该原件或复制品已由表演者发行或经表演者授权发行。
(2) Contracting Parties are exempt from the obligation of paragraph (1) unless the commercial rental has led to widespread copying of such fixations materially impairing the exclusive right of reproduction of performers [7].   二、除非商业性出租已导致此种录制品的广泛复制,从而严重损害表演者的专有复制权,否则缔约方被免除第一款规定的义务[7]

Article 10
Right of Making Available of Fixed Performances

第十条
提供已录制表演的权利

Performers shall enjoy the exclusive right of authorizing the making available to the public of their performances fixed in audiovisual fixations, by wire or wireless means, in such a way that members of the public may access them from a place and at a time individually chosen by them.   表演者应享有专有权,以授权通过有线或无线的方式向公众提供其以视听录制品录制的表演,使该表演可为公众中的成员在其个人选定的地点和时间获得。

Article 11
Right of Broadcasting and Communication to the Public

第十一条
广播和向公众传播的权利

(1) Performers shall enjoy the exclusive right of authorizing the broadcasting and communication to the public of their performances fixed in audiovisual fixations.   一、表演者应享有授权广播和向公众传播其以视听录制品录制的表演的专有权。
(2) Contracting Parties may in a notification deposited with the Director General of WIPO declare that, instead of the right of authorization provided for in paragraph (1), they will establish a right to equitable remuneration for the direct or indirect use of performances fixed in audiovisual fixations for broadcasting or for communication to the public. Contracting Parties may also declare that they will set conditions in their legislation for the exercise of the right to equitable remuneration.   二、缔约各方可以在向世界知识产权组织总干事交存的通知书中声明,它们将规定一项对于以视听录制品录制的表演直接或间接地用于广播或向公众传播获得合理报酬的权利,以代替本条第一款中规定的授权的权利。缔约各方还可以声明,它们将在立法中对行使该项获得合理报酬的权利规定条件。
(3) Any Contracting Party may declare that it will apply the provisions of paragraphs (1) or (2) only in respect of certain uses, or that it will limit their application in some other way, or that it will not apply the provisions of paragraphs (1) and (2) at all.   三、任何缔约方均可声明其将仅对某些使用情形适用本条第一款或第二款的规定,或声明其将以某种其他方式对其适用加以限制,或声明其将根本不适用第一款和第二款的规定。

Article 12
Transfer of Rights

第十二条
权利的转让

(1) A Contracting Party may provide in its national law that once a performer has consented to fixation of his or her performance in an audiovisual fixation, the exclusive rights of authorization provided for in Articles 7 to 11 of this Treaty shall be owned or exercised by or transferred to the producer of such audiovisual fixation subject to any contract to the contrary between the performer and the producer of the audiovisual fixation as determined by the national law.   一、缔约方可以在其国内法中规定,表演者一旦同意将其表演录制于视听录制品中,本条约第七条至第十一条所规定的进行授权的专有权应归该视听录制品的制作者所有,或应由其行使,或应向其转让,但表演者与视听录制品制作者之间按国内法的规定订立任何相反合同者除外。
(2) A Contracting Party may require with respect to audiovisual fixations produced under its national law that such consent or contract be in writing and signed by both parties to the contract or by their duly authorized representatives.   二、缔约方可以要求,对于依照其国内法的规定制作的视听录制品,此种同意或合同应采用书面形式,并应由合同当事人双方或由经其正式授权的代表签字。
(3) Independent of the transfer of exclusive rights described above, national laws or individual, collective or other agreements may provide the performer with the right to receive royalties or equitable remuneration for any use of the performance, as provided for under this Treaty including as regards Articles 10 and 11.   三、不依赖于上述专有权转让规定,国内法或者具有个人性质、集体性质或其他性质的协议可以规定,表演者有权依照本条约的规定,包括第十条和第十一条的规定,因表演的任何使用而获得使用费或合理报酬。

Article 13
Limitations and Exceptions

第十三条
限制与例外

(1) Contracting Parties may, in their national legislation, provide for the same kinds of limitations or exceptions with regard to the protection of performers as they provide for, in their national legislation, in connection with the protection of copyright in literary and artistic works.   一、缔约各方可以在其国内立法中,对给予表演者的保护规定与其国内立法给予文学和艺术作品的版权保护相同种类的限制或例外。
(2) Contracting Parties shall confine any limitations of or exceptions to rights provided for in this Treaty to certain special cases which do not conflict with a normal exploitation of the performance and do not unreasonably prejudice the legitimate interests of the performer [8].   二、缔约各方应使本条约中所规定权利的任何限制或例外仅限于某些不与表演的正常利用相抵触、也不致不合理地损害表演者合法利益的特殊情况[8]

Article 14
Term of Protection

第十四条
保护期

The term of protection to be granted to performers under this Treaty shall last, at least, until the end of a period of 50 years computed from the end of the year in which the performance was fixed.   依本条约给予表演者的保护期,应自表演录制之年年终算起,至少持续到50年期满为止。

Article 15
Obligations concerning Technological Measures

第十五条
关于技术措施的义务

Contracting Parties shall provide adequate legal protection and effective legal remedies against the circumvention of effective technological measures that are used by performers in connection with the exercise of their rights under this Treaty and that restrict acts, in respect of their performances, which are not authorized by the performers concerned or permitted by law [9][10].   缔约各方应规定适当的法律保护和有效的法律补救办法,制止规避由表演者为行使本条约所规定的权利而使用并限制对其表演实施未经该有关表演者许可的或法律不允许的行为的有效技术措施 [9][10]

Article 16
Obligations concerning Rights Management Information

第十六条
关于权利管理信息的义务

(1) Contracting Parties shall provide adequate and effective legal remedies against any person knowingly performing any of the following acts knowing, or with respect to civil remedies having reasonable grounds to know, that it will induce, enable, facilitate, or conceal an infringement of any right covered by this Treaty:   一、缔约各方应规定适当和有效的法律补救办法,制止任何人明知,或就民事补救而言,有合理根据知道其行为会诱使、促成、便利或包庇对本条约所规定的任何权利的侵犯,而故意实施以下活动:
(i) to remove or alter any electronic rights management information without authority;
  (1)未经许可去除或改变任何权利管理的电子信息;
(ii) to distribute, import for distribution, broadcast, communicate or make available to the public, without authority, performances or copies of performances fixed in audiovisual fixations knowing that electronic rights management information has been removed or altered without authority.
  (2)未经许可发行、为发行目的进口、广播、向公众传播或提供明知未经许可而被去除或改变权利管理电子信息的表演或以视听录制品录制的表演的复制品。
(2) As used in this Article, "rights management information" means information which identifies the performer, the performance of the performer, or the owner of any right in the performance, or information about the terms and conditions of use of the performance, and any numbers or codes that represent such information, when any of these items of information is attached to a performance fixed in an audiovisual fixation [11].   二、本条中的用语“权利管理信息”系指识别表演者、表演者的表演或对表演拥有任何权利的所有人的信息,或有关使用表演的条款和条件的信息,以及代表此种信息的任何数字或代码,各该项信息均附于以视听录制品录制的表演上[11]

Article 17
Formalities

第十七条
手续

The enjoyment and exercise of the rights provided for in this Treaty shall not be subject to any formality.   享有和行使本条约所规定的权利无须履行任何手续。

Article 18
Reservations and Notifications

第十八条
保留和通知

(1) Subject to provisions of Article 11(3), no reservations to this Treaty shall be permitted.   一、除第十一条第三款的规定外,本条约不允许有任何保留。
(2) Any notification under Article 11(2) or 19(2) may be made in instruments of ratification or accession, and the effective date of the notification shall be the same as the date of entry into force of this Treaty with respect to the Contracting Party having made the notification. Any such notification may also be made later, in which case the notification shall have effect three months after its receipt by the Director General of WIPO or at any later date indicated in the notification.   二、依第十一条第二款或第十九条第二款所作的任何通知,可以在批准书或加入书中提出,通知的生效日期应与本条约对作出通知的国家或政府间组织生效的日期相同。任何此种通知亦可随后提出,但在此情况下,通知应于世界知识产权组织总干事收到通知三个月后或通知中指明的任何更晚的日期生效。

Article 19
Application in Time

第十九条
时间上的适用范围

(1) Contracting Parties shall accord the protection granted under this Treaty to fixed performances that exist at the moment of the entry into force of this Treaty and to all performances that occur after the entry into force of this Treaty for each Contracting Party.   一、缔约各方应对本条约生效之时存在的已录制的表演,以及本条约对缔约各方生效之后进行的所有表演,给予本条约所规定的保护。
(2) Notwithstanding the provisions of paragraph (1), a Contracting Party may declare in a notification deposited with the Director General of WIPO that it will not apply the provisions of Articles 7 to 11 of this Treaty, or any one or more of those, to fixed performances that existed at the moment of the entry into force of this Treaty for each Contracting Party. In respect of such Contracting Party, other Contracting Parties may limit the application of the said Articles to performances that occurred after the entry into force of this Treaty for that Contracting Party.   二、尽管有本条第一款的规定,缔约方仍可以在向世界知识产权组织总干事交存的通知书中声明,对于本条约对每一缔约方生效之时存在的已录制的表演,将不适用本条约第七条至第十一条的规定,或不适用其中的任何一条或多条规定。对于此种缔约方,其他缔约方可以使所述各条的适用仅限于本条约对该缔约方生效之后进行的表演。
(3) The protection provided for in this Treaty shall be without prejudice to any acts committed, agreements concluded or rights acquired before the entry into force of this Treaty for each Contracting Party.   三、本条约规定的保护不得损害本条约对每一缔约方生效之前实施的任何行为、订立的任何协议或取得的任何权利。
(4) Contracting Parties may in their legislation establish transitional provisions under which any person who, prior to the entry into force of this Treaty, engaged in lawful acts with respect to a performance, may undertake with respect to the same performance acts within the scope of the rights provided for in Articles 5 and 7 to 11 after the entry into force of this Treaty for the respective Contracting Parties.   四、缔约各方可以在其立法中制定过渡性条款,规定凡在本条约生效之前就某一表演从事合法活动的人,可以在本条约对相应缔约方生效之后,就该同一表演从事与第五条和第七条至第十一条所规定的权利范围相符的活动。

Article 20
Provisions on Enforcement of Rights

第二十条
关于权利行使的条款

(1) Contracting Parties undertake to adopt, in accordance with their legal systems, the measures necessary to ensure the application of this Treaty.   一、缔约各方承诺根据其法律制度采取必要的措施,以确保本条约的适用。
(2) Contracting Parties shall ensure that enforcement procedures are available under their law so as to permit effective action against any act of infringement of rights covered by this Treaty, including expeditious remedies to prevent infringements and remedies which constitute a deterrent to further infringements.   二、缔约各方应确保依照其法律可以提供执法程序,以便能采取制止对本条约所规定权利的任何侵权行为的有效行动,包括防止侵权的即时补救和为遏制进一步侵权的补救。

Article 21
Assembly

第二十一条
大会

(1)   一、
(a) The Contracting Parties shall have an Assembly.
  (一)缔约方应设大会。
(b) Each Contracting Party shall be represented in the Assembly by one delegate who may be assisted by alternate delegates, advisors and experts.
  (二)每一缔约方应有一名代表出席大会,该代表可由副代表、顾问和专家协助。
(c) The expenses of each delegation shall be borne by the Contracting Party that has appointed the delegation. The Assembly may ask WIPO to grant financial assistance to facilitate the participation of delegations of Contracting Parties that are regarded as developing countries in conformity with the established practice of the General Assembly of the United Nations or that are countries in transition to a market economy.
  (三)各代表团的费用应由指派它的缔约方负担。大会可以要求世界知识产权组织(以下称为WIPO)提供财政援助,以便利按照联合国大会既定惯例认为是发展中国家或市场经济转型期国家的缔约方代表团参加。
(2)   二、
(a) The Assembly shall deal with matters concerning the maintenance and development of this Treaty and the application and operation of this Treaty.
  (一)大会应处理涉及维护和发展本条约及适用和实施本条约的事项。
(b) The Assembly shall perform the function allocated to it under Article 23(2) in respect of the admission of certain intergovernmental organizations to become party to this Treaty.
  (二)大会应履行依第二十三条第二款向其指定的关于接纳某些政府间组织成为本条约缔约方的职能。
(c) The Assembly shall decide the convocation of any diplomatic conference for the revision of this Treaty and give the necessary instructions to the Director General of WIPO for the preparation of such diplomatic conference.
  (三)大会应对召开任何修订本条约的外交会议作出决定,并给予世界知识产权组织总干事筹备此种外交会议的必要指示。
(3)   三、
(a) Each Contracting Party that is a State shall have one vote and shall vote only in its own name.
  (一)凡属国家的每一缔约方应有一票,并应只能以其自己的名义表决。
(b) Any Contracting Party that is an intergovernmental organization may participate in the vote, in place of its Member States, with a number of votes equal to the number of its Member States which are party to this Treaty. No such intergovernmental organization shall participate in the vote if any one of its Member States exercises its right to vote and vice versa.
  (二)凡属政府间组织的缔约方可以代替其成员国参加表决,其票数与其属本条约缔约方的成员国数目相等。如果此种政府间组织的任何一个成员国行使其表决权,则该组织不得参加表决,反之亦然。
(4) The Assembly shall meet upon convocation by the Director General and, in the absence of exceptional circumstances, during the same period and at the same place as the General Assembly of WIPO.   四、大会应由总干事召集,如无例外情况,应与世界知识产权组织大会同时同地举行。
(5) The Assembly shall endeavor to take its decisions by consensus and shall establish its own rules of procedure, including the convocation of extraordinary sessions, the requirements of a quorum and, subject to the provisions of this Treaty, the required majority for various kinds of decisions.   五、大会应努力通过协商一致作出决定,并应制定自己的议事规则,包括召集特别会议、法定人数的要求,以及按本条约的规定,作出各类决定所需的多数等规则。

Article 22
International Bureau

The International Bureau of WIPO shall perform the administrative tasks concerning the Treaty.   与本条约有关的行政工作应由世界知识产权组织国际局履行。

Article 23
Eligibility for Becoming Party to the Treaty

第二十三条
成为本条约缔约方的资格

(1) Any Member State of WIPO may become party to this Treaty.   一、世界知识产权组织的任何成员国均可以成为本条约的缔约方。
(2) The Assembly may decide to admit any intergovernmental organization to become party to this Treaty which declares that it is competent in respect of, and has its own legislation binding on all its Member States on, matters covered by this Treaty and that it has been duly authorized, in accordance with its internal procedures, to become party to this Treaty.   二、如果任何政府间组织声明其对于本条约涵盖的事项具有权限和具有约束其所有成员国的立法,并声明其根据其内部程序被正式授权要求成为本条约的缔约方,大会可以决定接纳该政府间组织成为本条约的缔约方。
(3) The European Union, having made the declaration referred to in the preceding paragraph in the Diplomatic Conference that has adopted this Treaty, may become party to this Treaty.   三、欧洲联盟在通过本条约的外交会议上作出上款提及的声明后,可以成为本条约的缔约方。

Article 24
Rights and Obligations under the Treaty

本条约规定的权利和义务

Subject to any specific provisions to the contrary in this Treaty, each Contracting Party shall enjoy all of the rights and assume all of the obligations under this Treaty.   除本条约有任何相反的具体规定以外,每一缔约方均应享有本条约规定的一切权利并承担本条约规定的一切义务。

Article 25
Signature of the Treaty

第二十五条
本条约的签署

This Treaty shall be open for signature at the headquarters of WIPO by any eligible party for one year after its adoption.   本条约通过后即在世界知识产权组织总部开放以供任何有资格的有关方签署,期限一年。

Article 26
Entry into Force of the Treaty

第二十六条
本条约的生效

This Treaty shall enter into force three months after 30 eligible parties referred to in Article 23 have deposited their instruments of ratification or accession.   本条约应在第二十三条所指的三十个有资格的有关方交存批准书或加入书三个月之后生效。

Article 27
Effective Date of Becoming Party to the Treaty

第二十七条
成为本条约缔约方的生效日期

This Treaty shall bind:   本条约应自下列日期起具有约束力:
(i) the 30 eligible parties referred to in Article 26, from the date on which this Treaty has entered into force;
  (1)对第二十六条提到的三十个有资格的有关方,自本条约生效之日起;
(ii) each other eligible party referred to in Article 23, from the expiration of three months from the date on which it has deposited its instrument of ratification or accession with the Director General of WIPO.
  (2)对第二十三条提到的每一个其他有资格的有关方,自其向世界知识产权组织总干事交存批准书或加入书之日满三个月起。

Article 28
Denunciation of the Treaty

第二十八条
退约

This Treaty may be denounced by any Contracting Party by notification addressed to the Director General of WIPO. Any denunciation shall take effect one year from the date on which the Director General of WIPO received the notification.   本条约的任何缔约方均可退出本条约,退约应通知世界知识产权组织总干事。任何退约应于世界知识产权组织总干事收到通知之日起一年后生效。

Article 29
Languages of the Treaty

本条约的语文

(1) This Treaty is signed in a single original in English, Arabic, Chinese, French, Russian and Spanish languages, the versions in all these languages being equally authentic.   一、本条约的签字原件为一份,以中文、阿拉伯文、英文、法文、俄文和西班牙文签署,各该文种的文本具有同等效力。
(2) An official text in any language other than those referred to in paragraph (1) shall be established by the Director General of WIPO on the request of an interested party, after consultation with all the interested parties. For the purposes of this paragraph, "interested party" means any Member State of WIPO whose official language, or one of whose official languages, is involved and the European Union, and any other intergovernmental organization that may become party to this Treaty, if one of its official languages is involved.   二、除本条第一款提到的语文外,任何其他语文的正式文本须由世界知识产权组织总干事应有关方请求,在与所有有关方磋商之后制定。在本款中,“有关方”系指涉及到其正式语文或正式语文之一的世界知识产权组织任何成员国,并且如果涉及到其正式语文之一,亦指欧洲联盟和可以成为本条约缔约方的任何其他政府间组织。

Depositary

The Director General of WIPO is the depositary of this Treaty.   世界知识产权组织总干事为本条约的保存人。
1 Agreed statement concerning Article 1: It is understood that nothing in this Treaty affects any rights or obligations under the WIPO Performances and Phonograms Treaty (WPPT) or their interpretation and it is further understood that paragraph 3 does not create any obligations for a Contracting Party to this Treaty to ratify or accede to the WPPT or to comply with any of its provisions. 1 关于第一条第一款的议定声明:各方达成共识,本条约的任何内容均不得影响《世界知识产权组织表演和录音制品条约》(WPPT)所规定的任何权利或义务或其解释;另外,各方达成共识,第3款不对本条约缔约方增加批准或加入《世界知识产权组织表演和录音制品条约》或遵守其任何规定的任何义务。
2 Agreed statement concerning Article 1(3): It is understood that Contracting Parties who are members of the World Trade Organization (WTO) acknowledge all the principles and objectives of the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) and understand that nothing in this Treaty affects the provisions of the TRIPS Agreement, including, but not limited to, the provisions relating to anti-competitive practices. 2 关于第一条第三款的议定声明:各方达成共识,系世界贸易组织成员的缔约方承认《与贸易有关的知识产权协定》(《TRIPS协定》)的各项原则与目标,并达成共识:本条约的任何内容均不影响《TRIPS协定》的规定,包括但不限于涉及反竞争行为的规定。
3 Agreed statement concerning Article 2(a):  It is understood that the definition of "performers" includes those who perform a literary or artistic work that is created or first fixed in the course of a performance. 3 关于第二条(一)款的议定声明:各方达成共识,表演者的定义涵盖凡对表演过程中创作的或首次录制的文学或艺术作品进行表演的人。
4 Agreed statement concerning Article 2(b): It is hereby confirmed that the definition of "audiovisual fixation" contained in Article 2(b) is without prejudice to Article 2(c) of the WPPT. 4 关于第二条(二)款的议定声明:特此确认,载于第二条()款的“视听录制品”的定义,不损害《世界知识产权组织表演和录音制品条约》的第二条()款。
5 Agreed statement concerning Article 5: For the purposes of this Treaty and without prejudice to any other treaty, it is understood that, considering the nature of audiovisual fixations and their production and distribution, modifications of a performance that are made in the normal course of exploitation of the performance, such as editing, compression, dubbing, or formatting, in existing or new media or formats, and that are made in the course of a use authorized by the performer, would not in themselves amount to modifications within the meaning of Article 5(1)(ii). Rights under Article 5(1)(ii) are concerned only with changes that are objectively prejudicial to the performer's reputation in a substantial way. It is also understood that the mere use of new or changed technology or media, as such, does not amount to modification within the meaning of Article 5(1)(ii). 5 关于第五条的议定声明:为本条约的目的,并在不损害任何其他条约的前提下,会议达成共识:鉴于视听录制品及其制作和发行的特点,在正常利用表演的过程中以及在经表演者授权的使用过程中对该表演所作的修改,诸如使用现有或新的媒体或格式进行编辑、压缩、配音或格式化编排,将不足以构成第五条第一款第(2)项意义下的修改。只有在客观上对表演者的声誉造成重大损害的改动才涉及第五条第一款第(2)项所规定的权利。会议还达成共识:纯粹使用新的或改进的技术或媒体,其本身不足以构成第五条第一款第(2)项意义下的修改。
6 Agreed statement concerning Article 7: The reproduction right, as set out in Article 7, and the exceptions permitted thereunder through Article 13, fully apply in the digital environment, in particular to the use of performances in digital form. It is understood that the storage of a protected performance in digital form in an electronic medium constitutes a reproduction within the meaning of this Article. 6 关于第七条的议定声明:第七条所规定的复制权及其通过第十三条所允许的例外,完全适用于数字环境,尤其是以数字形式使用表演的情况。各方达成共识,在电子媒体中以数字形式存储受保护的表演,构成该条意义下的复制。
7 Agreed statement concerning Articles 8 and 9: As used in these Articles, the expression "original and copies," being subject to the right of distribution and the right of rental under the said Articles, refers exclusively to fixed copies that can be put into circulation as tangible objects. 7 关于第八条和第九条的议定声明:这些条款中的用语“原件和复制品”,受各该条中发行权和出租权的约束,专指可以作为有形物品投放流通的固定的复制品。
8 Agreed statement concerning Article 13: The Agreed statement concerning Article 10 (on Limitations and Exceptions) of the WIPO Copyright Treaty (WCT) is applicable mutatis mutandis also to Article 13 (on Limitations and Exceptions) of the Treaty. 8 关于第十三条的议定声明:关于《世界知识产权组织版权条约》(WCT)第十条(涉及限制与例外)的议定声明,亦可比照适用于本条约的第十三条(涉及限制和例外)。
9 Agreed statement concerning Article 15 as it relates to Article 13: It is understood that nothing in this Article prevents a Contracting Party from adopting effective and necessary measures to ensure that a beneficiary may enjoy limitations and exceptions provided in that Contracting Party's national law, in accordance with Article 13, where technological measures have been applied to an audiovisual performance and the beneficiary has legal access to that performance, in circumstances such as where appropriate and effective measures have not been taken by rights holders in relation to that performance to enable the beneficiary to enjoy the limitations and exceptions under that Contracting Party's national law. Without prejudice to the legal protection of an audiovisual work in which a performance is fixed, it is further understood that the obligations under Article 15 are not applicable to performances unprotected or no longer protected under the national law giving effect to this Treaty. 9 与第十三条相关的关于第十五条的议定声明:各方达成共识,本条任何规定均不阻止缔约方采取有效而必要的措施,以确保当视听表演已采用技术措施而受益人有权合法使用该表演时,例如在权利人未对某一具体表演采取能让受益人享受国内法所规定的例外与限制的适当和有效措施的情况下,受益人能享受其国内法中根据第十三条作出的例外或限制规定。此外,在不损害录有表演的视听作品的法律保护的情况下,各方达成共识,第十五条规定的义务不适用于不受或不再受履行本条约的国内立法保护的表演。
10 Agreed statement concerning Article 15: The expression "technological measures used by performers" should, as this is the case regarding the WPPT, be construed broadly, referring also to those acting on behalf of performers, including their representatives, licensees or assignees, including producers, service providers, and persons engaged in communication or broadcasting using performances on the basis of due authorization. 10 关于第十五条的议定声明:“表演者使用的技术措施”一语,与《世界知识产权组织表演和录音制品条约》的情况一样,应作广义的理解,亦指代表表演者实施行为的人,包括其代理人、被许可人或受让人,包括制作者、服务提供者和经适当许可使用表演进行传播或广播的人。
