Preamble

The Contracting Parties, 缔约各方,
Desiring to develop and maintain the protection of the rights of performers and producers of phonograms in a manner as effective and uniform as possible,
  出于以尽可能有效和一致的方式发展和维护保护表演者和录音制品制作者权利的愿望,
Recognizing the need to introduce new international rules in order to provide adequate solutions to the questions raised by economic, social, cultural and technological developments,
  承认有必要采用新的国际规则,以提供解决由经济、社会、文化和技术发展所提出的问题的适当办法,
Recognizing the profound impact of the development and convergence of information and communication technologies on the production and use of performances and phonograms,

Recognizing the need to maintain a balance between the rights of performers and producers of phonograms and the larger public interest, particularly education, research and access to information,

CHAPTER I
General Provisions

第一章

Article 1
Relation to Other Conventions

第一条
与其他公约的关系

(1) Nothing in this Treaty shall derogate from existing obligations that Contracting Parties have to each other under the International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations done in Rome, October 26, 1961 (hereinafter the “Rome Convention”).   一、本条约的任何内容均不得减损缔约方相互之间依照于1961年10月26日在罗马签订的《保护表演者、录音制品制作者和广播组织国际公约》(以下称为“《罗马公约》”)已承担的现有义务。
(2) Protection granted under this Treaty shall leave intact and shall in no way affect the protection of copyright in literary and artistic works. Consequently, no provision of this Treaty may be interpreted as prejudicing such protection. [1]   二、依本条约授予的保护不得触动或以任何方式影响对文学和艺术作品版权的保护。因此,本条约的任何内容均不得被解释为损害此种保护。[1]
(3) This Treaty shall not have any connection with, nor shall it prejudice any rights and obligations under, any other treaties.   三、本条约不得与任何其他条约有任何关联,亦不得损害依任何其他条约的任何权利和义务。

Article 2
Definitions

第二条
定义

For the purposes of this Treaty:   在本条约中:
(a) “performers” are actors, singers, musicians, dancers, and other persons who act, sing, deliver, declaim, play in, interpret, or otherwise perform literary or artistic works or expressions of folklore;
  (一)“表演者”指演员、歌唱家、音乐家、舞蹈家以及表演、歌唱、演说、朗诵、演奏、表现、或以其他方式表演文学或艺术作品或民间文学艺术作品的其他人员;
(b) “phonogram” means the fixation of the sounds of a performance or of other sounds, or of a representation of sounds, other than in the form of a fixation incorporated in a cinematographic or other audiovisual work; [2]
  (二)“录音制品”系指除以电影作品或其他音像作品所含的录制形式之外,对表演的声音、或其他声音、或声音表现物所进行的录制;[2]
(c) “fixation” means the embodiment of sounds, or of the representations thereof, from which they can be perceived, reproduced or communicated through a device;
  (三)“录制”系指对声音或声音表现物的体现,从中通过某种装置可感觉、复制或传播该声音;
(d) “producer of a phonogram” means the person, or the legal entity, who or which takes the initiative and has the responsibility for the first fixation of the sounds of a performance or other sounds, or the representations of sounds;
  (四)“录音制品制作者”系指对首次将表演的声音、或其他声音、或声音表现物录制下来提出动议并负有责任的自然人或法人;
(e) “publication” of a fixed performance or a phonogram means the offering of copies of the fixed performance or the phonogram to the public, with the consent of the rightholder, and provided that copies are offered to the public in reasonable quantity; [3]
  (五)“发行”录制的表演或录音制品系指经权利持有人同意并在以合理的数量向公众提供复制品的条件下,将录制的表演或录音制品的复制品提供给公众;[3]
(f) “broadcasting” means the transmission by wireless means for public reception of sounds or of images and sounds or of the representations thereof; such transmission by satellite is also “broadcasting”; transmission of encrypted signals is “broadcasting” where the means for decrypting are provided to the public by the broadcasting organization or with its consent;
  (六)“广播”系指以无线方式的播送,使公众能接收声音、或图象和声音、或图象和声音表现物;通过卫星进行的此种播送亦为“广播”;播送密码信号,如果广播组织或经其同意向公众提供了解码的手段,则是“广播”;
(g) “communication to the public” of a performance or a phonogram means the transmission to the public by any medium, otherwise than by broadcasting, of sounds of a performance or the sounds or the representations of sounds fixed in a phonogram. For the purposes of Article 15, “communication to the public” includes making the sounds or representations of sounds fixed in a phonogram audible to the public.
  (七)“向公众传播”表演或录音制品系指通过除广播以外的任何媒体向公众播送表演的声音或以录音制品录制的声音或声音表现物。在第十五条中,“向公众传播”包括使公众能听到以录音制品录制的声音或声音表现物。

Article 3
Beneficiaries of Protection under this Treaty [4]

第三条
依本条约受保护的受益人[4]

(1) Contracting Parties shall accord the protection provided under this Treaty to the performers and producers of phonograms who are nationals of other Contracting Parties.   一、缔约各方应将依本条约规定的保护给予系其他缔约方国民的表演者和录音制品制作者。
(2) The nationals of other Contracting Parties shall be understood to be those performers or producers of phonograms who would meet the criteria for eligibility for protection provided under the Rome Convention, were all the Contracting Parties to this Treaty Contracting States of that Convention. In respect of these criteria of eligibility, Contracting Parties shall apply the relevant definitions in Article 2 of this Treaty. [5]   二、其他缔约方的国民应被理解为符合《罗马公约》规定的标准、有资格受到保护的表演者或录音制品制作者,如同本条约的全体缔约方均假设为该公约缔约国的情形。对于这些资格标准,缔约各方应适用本条约第二条中的有关定义。[5]
(3) Any Contracting Party availing itself of the possibilities provided in Article 5(3) of the Rome Convention or, for the purposes of Article 5 of the same Convention, Article 17 thereof shall make a notification as foreseen in those provisions to the Director General of the World Intellectual Property Organization (WIPO).   三、任何利用《罗马公约》第五条第三款所规定的可能性、或为该公约第五条的目的利用《罗马公约》第十七条所规定的可能性的缔约方,应向世界知识产权组织(WIPO)总干事作出那些条款所预先规定的通知。

Article 4
National Treatment

第四条
国民待遇

(1) Each Contracting Party shall accord to nationals of other Contracting Parties, as defined in Article 3(2), the treatment it accords to its own nationals with regard to the exclusive rights specifically granted in this Treaty, and to the right to equitable remuneration provided for in Article 15 of this Treaty.   一、在本条约所专门授予的专有权以及本条约第十五条所规定的获得合理报酬的权利方面,每个缔约方均应将其给予本国国民的待遇给予第三条第二款所定义的其他缔约方的国民。
(2) The obligation provided for in paragraph (1) does not apply to the extent that another Contracting Party makes use of the reservations permitted by Article 15(3) of this Treaty.   二、本条第一款规定的义务不适用于另一缔约方使用了本条约第十五条第三款允许的保留的情况。

CHAPTER II
Rights of Performers

Article 5
Moral Rights of Performers

第五条
表演者的精神权利

(1) Independently of a performer’s economic rights, and even after the transfer of those rights, the performer shall, as regards his live aural performances or performances fixed in phonograms, have the right to claim to be identified as the performer of his performances, except where omission is dictated by the manner of the use of the performance, and to object to any distortion, mutilation or other modification of his performances that would be prejudicial to his reputation.   一、不依赖于表演者的经济权利,甚至在这些权利转让之后,表演者仍应对于其现场有声表演或以录音制品录制的表演有权要求承认其系表演的表演者,除非使用表演的方式决定可省略不提其系表演者;并有权反对任何对其表演进行将有损其名声的歪曲、篡改或其他修改。
(2) The rights granted to a performer in accordance with paragraph (1) shall, after his death, be maintained, at least until the expiry of the economic rights, and shall be exercisable by the persons or institutions authorized by the legislation of the Contracting Party where protection is claimed. However, those Contracting Parties whose legislation, at the moment of their ratification of or accession to this Treaty, does not provide for protection after the death of the performer of all rights set out in the preceding paragraph may provide that some of these rights will, after his death, cease to be maintained.   二、根据本条第一款授予表演者的权利在其死后应继续保留,至少到其经济权利期满为止,并应可由被要求提供保护的缔约方立法所授权的个人或机构行使。但批准或加入本条约时其立法尚未规定在表演者死后保护上款所述之全部权利的缔约方,可规定其中部分权利在表演者死后不再保留。
(3) The means of redress for safeguarding the rights granted under this Article shall be governed by the legislation of the Contracting Party where protection is claimed.   三、为保障本条所授予的权利而采取的补救办法应由被要求提供保护的缔约方立法规定。

Article 6
Economic Rights of Performers in their Unfixed Performances

第六条
表演者对其尚未录制的表演的经济权利

Performers shall enjoy the exclusive right of authorizing, as regards their performances:   表演者应享有专有权,对于其表演授权:
(i) the broadcasting and communication to the public of their unfixed performances except where the performance is already a broadcast performance; and
  (1)广播和向公众传播其尚未录制的表演,除非该表演本身已属广播表演;和
(ii) the fixation of their unfixed performances.
  (2)录制其尚未录制的表演。

Article 7
Right of Reproduction

第七条
复制权

Performers shall enjoy the exclusive right of authorizing the direct or indirect reproduction of their performances fixed in phonograms, in any manner or form. [6]   表演者应享有授权以任何方式或形式对其以录音制品录制的表演直接或间接地进行复制的专有权。[6]

Article 8
Right of Distribution

第八条
发行权

(1) Performers shall enjoy the exclusive right of authorizing the making available to the public of the original and copies of their performances fixed in phonograms through sale or other transfer of ownership.   一、表演者应享有授权通过销售或其他所有权转让形式向公众提供其以录音制品录制的表演的原件或复制品的专有权。
(2) Nothing in this Treaty shall affect the freedom of Contracting Parties to determine the conditions, if any, under which the exhaustion of the right in paragraph (1) applies after the first sale or other transfer of ownership of the original or a copy of the fixed performance with the authorization of the performer. [3]   二、对于在已录制的表演的原件或复制品经表演者授权被首次销售或其他所有权转让之后适用本条第一款中权利的用尽所依据的条件(如有此种条件),本条约的任何内容均不得影响缔约各方确定该条件的自由。[3]

Article 9
Right of Rental

第九条
出租权

(1) Performers shall enjoy the exclusive right of authorizing the commercial rental to the public of the original and copies of their performances fixed in phonograms as determined in the national law of Contracting Parties, even after distribution of them by, or pursuant to, authorization by the performer.   一、表演者应按缔约各方国内法中的规定享有授权将其以录音制品录制的表演的原件和复制品向公众进行商业性出租的专有权,即使该原件或复制品已由表演者发行或根据表演者的授权发行。
(2) Notwithstanding the provisions of paragraph (1), a Contracting Party that, on April 15, 1994, had and continues to have in force a system of equitable remuneration of performers for the rental of copies of their performances fixed in phonograms, may maintain that system provided that the commercial rental of phonograms is not giving rise to the material impairment of the exclusive right of reproduction of performers. [3]   二、尽管有本条第一款的规定,任何缔约方如在1994年4月15日已有且现仍实行表演者出租其以录音制品录制的表演的复制品获得合理报酬的制度,只要录音制品的商业性出租没有引起对表演者复制专有权的严重损害,即可保留这一制度。[3]

Article 10
Right of Making Available of Fixed Performances

第十条
提供已录制表演的权利

Performers shall enjoy the exclusive right of authorizing the making available to the public of their performances fixed in phonograms, by wire or wireless means, in such a way that members of the public may access them from a place and at a time individually chosen by them.   表演者应享有专有权,以授权通过有线或无线的方式向公众提供其以录音制品录制的表演,使该表演可为公众中的成员在其个人选定的地点和时间获得。

CHAPTER III
Rights of Producers of Phonograms

第三章
录音制品制作者的权利

Article 11
Right of Reproduction

第十一条
复制权

Producers of phonograms shall enjoy the exclusive right of authorizing the direct or indirect reproduction of their phonograms, in any manner or form. [6]   录音制品制作者应享有授权以任何方式或形式对其录音制品直接或间接地进行复制的专有权。[6]

Article 12
Right of Distribution

第十二条
发行权

(1) Producers of phonograms shall enjoy the exclusive right of authorizing the making available to the public of the original and copies of their phonograms through sale or other transfer of ownership.   一、录音制品制作者应享有授权通过销售或其他所有权转让形式向公众提供其录音制品的原件或复制品的专有权。
(2) Nothing in this Treaty shall affect the freedom of Contracting Parties to determine the conditions, if any, under which the exhaustion of the right in paragraph (1) applies after the first sale or other transfer of ownership of the original or a copy of the phonogram with the authorization of the producer of the phonogram. [3]   二、对于在录音制品的原件或复制品经录音制品制作者授权被首次销售或其他所有权转让之后适用本条第一款中权利的用尽所依据的条件(如有此种条件),本条约的任何内容均不得影响缔约各方确定该条件的自由。[3]

Article 13
Right of Rental

第十三条
出租权

(1) Producers of phonograms shall enjoy the exclusive right of authorizing the commercial rental to the public of the original and copies of their phonograms, even after distribution of them, by or pursuant to, authorization by the producer.   一、录音制品制作者应享有授权对其录音制品的原件和复制品向公众进行商业性出租的专有权,即使该原件或复制品已由录音制品制作者发行或根据录音制品制作者的授权发行。
(2) Notwithstanding the provisions of paragraph (1), a Contracting Party that, on April 15, 1994, had and continues to have in force a system of equitable remuneration of producers of phonograms for the rental of copies of their phonograms, may maintain that system provided that the commercial rental of phonograms is not giving rise to the material impairment of the exclusive rights of reproduction of producers of phonograms. [3]   二、尽管有本条第一款的规定,任何缔约方如在1994年4月15日已有且现仍实行录音制品制作者出租其录音制品的复制品获得合理报酬的制度,只要录音制品的商业性出租没有引起对录音制品制作者复制专有权的严重损害,即可保留这一制度。[3]

Article 14
Right of Making Available of Phonograms

第十四条
提供录音制品的权利

Producers of phonograms shall enjoy the exclusive right of authorizing the making available to the public of their phonograms, by wire or wireless means, in such a way that members of the public may access them from a place and at a time individually chosen by them.   录音制品制作者应享有专有权,以授权通过有线或无线的方式向公众提供其录音制品,使该录音制品可为公众中的成员在其个人选定的地点和时间获得。

CHAPTER IV
Common Provisions

第四章
共同条款

Article 15
Right to Remuneration for Broadcasting and Communication to the Public

第十五条
因广播和向公众传播获得报酬的权利

(1) Performers and producers of phonograms shall enjoy the right to a single equitable remuneration for the direct or indirect use of phonograms published for commercial purposes for broadcasting or for any communication to the public.   一、对于将为商业目的发行的录音制品直接或间接地用于广播或用于对公众的任何传播,表演者和录音制品制作者应享有获得一次性合理报酬的权利。
(2) Contracting Parties may establish in their national legislation that the single equitable remuneration shall be claimed from the user by the performer or by the producer of a phonogram or by both. Contracting Parties may enact national legislation that, in the absence of an agreement between the performer and the producer of a phonogram, sets the terms according to which performers and producers of phonograms shall share the single equitable remuneration.   二、缔约各方可在其国内立法中规定,该一次性合理报酬应由表演者、或由录音制品制作者或由二者向用户索取。缔约各方可制定国内立法,对表演者和录音制品制作者之间如未达成协议,表演者和录音制品制作者应如何分配该一次性合理报酬所依据的条件作出规定。
(3) Any Contracting Party may, in a notification deposited with the Director General of WIPO, declare that it will apply the provisions of paragraph (1) only in respect of certain uses, or that it will limit their application in some other way, or that it will not apply these provisions at all.   三、任何缔约方均可在向世界知识产权组织总干事交存的通知书中,声明其将仅对某些使用适用本条第一款的规定,或声明其将以某种其他方式对其适用加以限制,或声明其将根本不适用这些规定。
(4) For the purposes of this Article, phonograms made available to the public by wire or wireless means in such a way that members of the public may access them from a place and at a time individually chosen by them shall be considered as if they had been published for commercial purposes. [7], [8]   四、在本条中,以有线或无线的方式向公众提供的、可为公众中的成员在其个人选定的地点和时间获得的录音制品应被认为仿佛其原本即为商业目的而发行。[7], [8]

Article 16
Limitations and Exceptions

第十六条
限制与例外

(1) Contracting Parties may, in their national legislation, provide for the same kinds of limitations or exceptions with regard to the protection of performers and producers of phonograms as they provide for, in their national legislation, in connection with the protection of copyright in literary and artistic works.   一、缔约各方在其国内立法中,可在对表演者和录音制品制作者的保护方面规定与其国内立法中对文学和艺术作品的版权保护所规定的相同种类的限制或例外。
(2) Contracting Parties shall confine any limitations of or exceptions to rights provided for in this Treaty to certain special cases which do not conflict with a normal exploitation of the performance or phonogram and do not unreasonably prejudice the legitimate interests of the performer or of the producer of the phonogram. [6], [9]   二、缔约各方应将对本条约所规定权利的任何限制或例外限于某些不与录音制品的正常利用相抵触、也不无理地损害表演者或录音制品制作者合法利益的特殊情况。[6], [9]

Article 17
Term of Protection

第十七条
保护期

(1) The term of protection to be granted to performers under this Treaty shall last, at least, until the end of a period of 50 years computed from the end of the year in which the performance was fixed in a phonogram.   一、依本条约授予表演者的保护期,应自表演以录音制品录制之年年终算起,至少持续到50年期满为止。
(2) The term of protection to be granted to producers of phonograms under this Treaty shall last, at least, until the end of a period of 50 years computed from the end of the year in which the phonogram was published, or failing such publication within 50 years from fixation of the phonogram, 50 years from the end of the year in which the fixation was made.   二、依本条约授予录音制品制作者的保护期,应自该录音制品发行之年年终算起,至少持续到50年期满为止;或如果录音制品自录制完成起50年内未被发行,则保护期应自录制完成之年年终起至少持续50年。

Article 18
Obligations concerning Technological Measures

第十八条
关于技术措施的义务

Contracting Parties shall provide adequate legal protection and effective legal remedies against the circumvention of effective technological measures that are used by performers or producers of phonograms in connection with the exercise of their rights under this Treaty and that restrict acts, in respect of their performances or phonograms, which are not authorized by the performers or the producers of phonograms concerned or permitted by law.   缔约各方应规定适当的法律保护和有效的法律补救办法,制止规避由表演者或录音制品制作者为行使本条约所规定的权利而使用的、对就其表演或录音制品进行未经该有关表演者或录音制品制作者许可、或未由法律准许的行为加以约束的有效技术措施。

Article 19
Obligations concerning Rights Management Information

第十九条
关于权利管理信息的义务

(1) Contracting Parties shall provide adequate and effective legal remedies against any person knowingly performing any of the following acts knowing, or with respect to civil remedies having reasonable grounds to know, that it will induce, enable, facilitate or conceal an infringement of any right covered by this Treaty:   一、缔约各方应规定适当和有效的法律补救办法,制止任何人明知、或就民事补救而言有合理根据知道其行为会诱使、促成、便利或包庇对本条约所涵盖的任何权利的侵犯而故意从事以下行为:
(i) to remove or alter any electronic rights management information without authority;
  (1)未经许可去除或改变任何权利管理的电子信息;
(ii) to distribute, import for distribution, broadcast, communicate or make available to the public, without authority, performances, copies of fixed performances or phonograms knowing that electronic rights management information has been removed or altered without authority.
  (2)未经许可发行、为发行目的进口、广播、向公众传播或提供明知已被未经许可去除或改变权利管理电子信息的表演、录制的表演或录音制品的复制品。
(2) As used in this Article, “rights management information” means information which identifies the performer, the performance of the performer, the producer of the phonogram, the phonogram, the owner of any right in the performance or phonogram, or information about the terms and conditions of use of the performance or phonogram, and any numbers or codes that represent such information, when any of these items of information is attached to a copy of a fixed performance or a phonogram or appears in connection with the communication or making available of a fixed performance or a phonogram to the public. [10]   二、本条中的用语“权利管理信息“系指识别表演者、表演者的表演、录音制品制作者、录音制品、对表演或录音制品拥有任何权利的所有人的信息,或有关使用表演或录音制品的条款和条件的信息,和代表此种信息的任何数字或代码,各该项信息均附于录制的表演或录音制品的每件复制品上或在录制的表演或录音制品向公众提供时出现。[10]

Article 20
Formalities

第二十条
手续

The enjoyment and exercise of the rights provided for in this Treaty shall not be subject to any formality.   享有和行使本条约所规定的权利无须履行任何手续。

Article 21
Reservations

第二十一条
保留

Subject to the provisions of Article 15(3), no reservations to this Treaty shall be permitted.   除第十五条第三款的规定外,不允许对本条约有任何保留。

Article 22
Application in Time

第二十二条
适用的时限

(1) Contracting Parties shall apply the provisions of Article 18 of the Berne Convention, mutatis mutandis, to the rights of performers and producers of phonograms provided for in this Treaty.   一、缔约各方应将《伯尔尼公约》第十八条的规定比照适用于本条约所规定的表演者和录音制品制作者的权利。
(2) Notwithstanding paragraph (1), a Contracting Party may limit the application of Article 5 of this Treaty to performances which occurred after the entry into force of this Treaty for that Party.   二、尽管有本条第一款的规定,缔约方可将对本条约第五条的适用限制于在本条约对该缔约方生效之后进行的表演。

Article 23
Provisions on Enforcement of Rights

第二十三条
关于权利行使的条款

(1) Contracting Parties undertake to adopt, in accordance with their legal systems, the measures necessary to ensure the application of this Treaty.   一、缔约各方承诺根据其法律制度采取必要的法律措施,以确保本条约的适用。
(2) Contracting Parties shall ensure that enforcement procedures are available under their law so as to permit effective action against any act of infringement of rights covered by this Treaty, including expeditious remedies to prevent infringements and remedies which constitute a deterrent to further infringements.   二、缔约各方应确保依照其法律可以提供执法程序,以便能采取制止对本条约所涵盖权利的任何侵犯行为的有效行动,包括防止侵权的快速补救和为遏制进一步侵权的补救。

CHAPTER V
Administrative and Final Clauses

第五章
行政条款和最后条款

Article 24
Assembly

第二十四条
大会

(1)   一、
(a) The Contracting Parties shall have an Assembly.
  (一)缔约方应设大会。
(b) Each Contracting Party shall be represented by one delegate who may be assisted by alternate delegates, advisors and experts.
  (二)每一缔约方应有一名代表,该代表可由副代表、顾问和专家协助。
(c) The expenses of each delegation shall be borne by the Contracting Party that has appointed the delegation. The Assembly may ask WIPO to grant financial assistance to facilitate the participation of delegations of Contracting Parties that are regarded as developing countries in conformity with the established practice of the General Assembly of the United Nations or that are countries in transition to a market economy.
  (三)各代表团的费用应由指派它的缔约方负担。大会可要求世界知识产权组织(以下称为“本组织”)提供财政援助,以便利按照联合国大会既定惯例认为是发展中国家或向市场经济转轨的国家的缔约方代表团参加。
(2)   二、
(a) The Assembly shall deal with matters concerning the maintenance and development of this Treaty and the application and operation of this Treaty.
  (一)大会应处理涉及维护和发展本条约及适用和实施本条约的事项。
(b) The Assembly shall perform the function allocated to it under Article 26(2) in respect of the admission of certain intergovernmental organizations to become party to this Treaty.
  (二)大会应履行依第二十六条第二款向其指定的关于接纳某些政府间组织成为本条约缔约方的职能。
(c) The Assembly shall decide the convocation of any diplomatic conference for the revision of this Treaty and give the necessary instructions to the Director General of WIPO for the preparation of such diplomatic conference.
  (三)大会应对召开任何修订本条约的外交会议作出决定,并给予本组织总干事筹备此种外交会议的必要指示。
(3)   三、
(a) Each Contracting Party that is a State shall have one vote and shall vote only in its own name.
  (一)凡属国家的每一缔约方应有一票,并应只能以其自己的名义表决。
(b) Any Contracting Party that is an intergovernmental organization may participate in the vote, in place of its Member States, with a number of votes equal to the number of its Member States which are party to this Treaty. No such intergovernmental organization shall participate in the vote if any one of its Member States exercises its right to vote and vice versa.
  (二)凡属政府间组织的缔约方可代替其成员国参加表决,其票数与其属本条约缔约方的成员国数目相等。如果此种政府间组织的任何一个成员国行使其表决权,则该组织不得参加表决,反之亦然。
(4) The Assembly shall meet in ordinary session once every two years upon convocation by the Director General of WIPO.   四、大会应每两年召开一次例会,由本组织总干事召集。
(5) The Assembly shall establish its own rules of procedure, including the convocation of extraordinary sessions, the requirements of a quorum and, subject to the provisions of this Treaty, the required majority for various kinds of decisions.   五、大会应制定其本身的议事规则,其中包括特别会议的召集、法定人数的要求及在不违反本条约规定的前提下作出各种决定所需的多数。

Article 25
International Bureau

The International Bureau of WIPO shall perform the administrative tasks concerning the Treaty.   本组织的国际局应履行与本条约有关的行政工作。

Article 26
Eligibility for Becoming Party to the Treaty

第二十六条
成为本条约缔约方的资格

(1) Any Member State of WIPO may become party to this Treaty.   一、本组织的任何成员国均可成为本条约的缔约方。
(2) The Assembly may decide to admit any intergovernmental organization to become party to this Treaty which declares that it is competent in respect of, and has its own legislation binding on all its Member States on, matters covered by this Treaty and that it has been duly authorized, in accordance with its internal procedures, to become party to this Treaty.   二、如果任何政府间组织声明其对于本条约涵盖的事项具有权限和具有约束其所有成员国的立法,并声明其根据其内部程序被正式授权要求成为本条约的缔约方,大会可决定接纳该政府间组织成为本条约的缔约方。
(3) The European Community, having made the declaration referred to in the preceding paragraph in the Diplomatic Conference that has adopted this Treaty, may become party to this Treaty.   三、欧洲共同体在通过本条约的外交会议上做出上款提及的声明后,可成为本条约的缔约方。

Article 27
Rights and Obligations under the Treaty

Subject to any specific provisions to the contrary in this Treaty, each Contracting Party shall enjoy all of the rights and assume all of the obligations under this Treaty.   除本条约有任何相反的具体规定以外,每一缔约方均应享有本条约规定的一切权利并承担本条约规定的一切义务。

Article 28
Signature of the Treaty

第二十八条
本条约的签署

This Treaty shall be open for signature until December 31, 1997, by any Member State of WIPO and by the European Community.   本条约应在1997年12月31日以前开放供本组织的任何成员国和欧洲共同体签署。

Article 29
Entry into Force of the Treaty

This Treaty shall enter into force three months after 30 instruments of ratification or accession by States have been deposited with the Director General of WIPO.   本条约应于三十个国家向本组织总干事交存批准书或加入书三个月之后生效。

Article 30
Effective Date of Becoming Party to the Treaty

第三十条
成为本条约缔约方的生效日期

This Treaty shall bind:   本条约应自下列日期起具有约束力:
(i) the 30 States referred to in Article 29, from the date on which this Treaty has entered into force;
  (1)对第二十九条提到的三十个国家,自本条约生效之日起;
(ii) each other State from the expiration of three months from the date on which the State has deposited its instrument with the Director General of WIPO;
  (2)对其他各国,自该国向本组织总干事交存文书之日满三个月起;
(iii) the European Community, from the expiration of three months after the deposit of its instrument of ratification or accession if such instrument has been deposited after the entry into force of this Treaty according to Article 29, or, three months after the entry into force of this Treaty if such instrument has been deposited before the entry into force of this Treaty;
  (3)对欧洲共同体,如果其在本条约根据第二十九条生效后交存批准书或加入书,则自交存此种文书后满三个月起,或如果其在本条约生效前交存准书或加入书,则自本条约生效后满三个月起;
(iv) any other intergovernmental organization that is admitted to become party to this Treaty, from the expiration of three months after the deposit of its instrument of accession.
  (4)对被接纳成为本条约缔约方的任何其他政府间组织,自该组织交存加入书后满三个月起。

Article 31
Denunciation of the Treaty

This Treaty may be denounced by any Contracting Party by notification addressed to the Director General of WIPO. Any denunciation shall take effect one year from the date on which the Director General of WIPO received the notification.   本条约的任何缔约方均可退出本条约,退约应通知本组织总干事。任何退约应于本组织总干事收到通知之日起一年后生效。

Article 32
Languages of the Treaty

(1) This Treaty is signed in a single original in English, Arabic, Chinese, French, Russian and Spanish languages, the versions in all these languages being equally authentic.   一、本条约的签字原件应为一份,以英文、阿拉伯文、中文、法文、俄文和西班牙文签署,各该文种的文本具有同等效力。
(2) An official text in any language other than those referred to in paragraph (1) shall be established by the Director General of WIPO on the request of an interested party, after consultation with all the interested parties. For the purposes of this paragraph, “interested party” means any Member State of WIPO whose official language, or one of whose official languages, is involved and the European Community, and any other intergovernmental organization that may become party to this Treaty, if one of its official languages is involved.   二、除本条第一款提到的语文外,任何其他语文的正式文本须由总干事应有关当事方请求,在与所有有关当事方磋商之后制定。在本款中,“有关当事方“系指涉及到其正式语文或正式语文之一的本组织任何成员国,并且如果涉及到其正式语文之一,亦指欧洲共同体和可成为本条约缔约方的任何其他政府间组织。

Article 33
Depositary

The Director General of WIPO is the depositary of this Treaty.   本组织总干事为本条约的保存人。
1 Agreed statement concerning Article 1(2): It is understood that Article 1(2) clarifies the relationship between rights in phonograms under this Treaty and copyright in works embodied in the phonograms. In cases where authorization is needed from both the author of a work embodied in the phonogram and a performer or producer owning rights in the phonogram, the need for the authorization of the author does not cease to exist because the authorization of the performer or producer is also required, and vice versa. 1 关于第一条第二款的议定声明:不言而喻,第一条第二款澄清本条约规定的对录音制品的权利与以录音制品体现的作品的版权之间的关系。在需要以录音制品体现的作品的作者与对录音制品持有权利的表演者或制作者许可的情况下,获得作者许可的需要并非因同时还需获表演者或制作者的许可而不复存在,反之亦然。

Similarly, these provisions should be understood to permit Contracting Parties to devise new exceptions and limitations that are appropriate in the digital network environment.
